BE IT RESOLVED By the City Council of the City of Baldwin Park as follows: WHEREAS, by Resolution No. 73-81, a public hearing was called for June 6, 1973, at the hour of 7:30 P.M., in the Council Chambers in the City Hall, Baldwin Park, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service, within those certain areas of the City described assail in the City of Baldwin Park. County of Los Angeles. State of California, generally described as follows: UNDERGROUND UTILITY DISTRICT NO. 2 Beginning at the southeast corner of Ramona Boulevard and Maine Avenue as it existed April, 1973); thence south- westerly along the northwesterly line of Tract Map 899. in the City of Baldwin Park, County of Los Angeles, State of California, as per map recorded in Book 18, page 95 of maps in the office of the recorder of said County to its point of intersection with the centerline of Loray Place as it existed April. 1973); thence southeasterly along said centerline of Loray Place to its point of inter- section with the centerline of Maine Avenue as it existed April, 1973); thence southwesterly along said centerline of Maine Avenue to its point of intersection with the centerline of Adoue Place as it existed April, 1973); thence south- easterly along said centerline of Adoue Place to a line that is parallel with and distant 110 feet southeasterly measured at right angles from said centerline of Maine Avenue; thence northeasterly along the above mentioned parallel line to the northeasterly line of Lot 74 of said Tract No. 899; thence southeasterly alone said northeasterly line of Lot 74 to a line that is parallel with and distant 20 feet measured at right angles from the southeasterly line of saic Tract No. 899; thence northeasterly along last mentioned parallel line to Us intersection with the prolongation of the northeasterly line of Pacific Avenue as it existed April, 1973); thence northwesterly along said northeasterly line of Pacific Avenue to the easterly line of Maine Avenue as it existed April, 1973); thence northerly to the point of beginning. UNDERGROUND UTILITY DISTRICT NO. 3 Beginning at the intersection of the centerline of LaRica Avenue as it existed April. 1973) and the prolongation of the northerly line of Tract No. 17496 in the City of Ba'dwin Park. County of Los Angeles, State of California as per map recorded in Book 618, pages 12-13 of maps in the office of the recorder of said County); thence easterly along said northerly line of Tract No. 17496 to a line that is paralle' with and distant 70 feet westerly measured at right angles from the centerline of Baldwin Park Boule- vard as shown on Tract No. 17496); thence northerly along iibove mentioned parallel line to a line that is parallel with and distant northerly 430 feet measured at right angles from said northerly line of Tract No. 17496; thence easterly atona last mentioned parallel line to its intersection with said centerline of Baldwin Park Boulevard; thence southerly along said centerline of Baldwin Park Boulevard to its intersection with the centerline of Ramona Boulevard as 1t existed April, 1973.'; thence southwesterly along said centerline of Ramona Boulevard t> Us intersection with said centerline of LaRica Avneue; thence northwesterly and northerly along said centerline of LaRica Avenue to the point of beginning. WHEREAS, notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and JHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard. Attached hereto, marked Exhibit A", and hereby Incorporated as a part of this resolution, are the maps delineating the boundaries of said Districts; RESOLVED, FURTHER, that the City Council does hereby fix January 1, 1975 as the date on which affected property owners must be ready to receive underground service. and does hereby order the removal of a11 poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, co—unlcation, or similar or associated service within Underground Utility Districts No. 2 and 3 on or before July 1, 1975; RESOLVED. FURTHER, that the City Clerk is hereby Instructed to notify all affected utilities and all persons owning real property Within Underground Utility Districts No. 2 and 3 of the adoption of this Resolution within ten 10) days after the dace of sucn adoption. Said City Clerk shall further notify said property owners of the necessity that. If they or any person occupying such property desire to continue to receive electric, communication or other similar or associated service, they or such occupant shall by the date fixed in this Resolution, provide all necessary facility changes on their pre- mises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Comnlsslon of the State of Calif- ornia. Such notification shall be made by mailing a copy of this Resolution together wich a copy of said Ordinance No. 525, to a11 affected property owners as such are shown on the last equalized assessment roll and to the affected utilities; RESOLVED, FURTHER, that the City Council hereby finds and determines as follows: SECTION 1. The Underground Utility Districts herein created are in the qeneral public interest for the following reasons: 1. The underground Ing to be accomplished will avoid or eliminate an unusually heavy concentration of overhead distribution facil- ities"; 2. The streets, roads or rights of way in the District are exten- sively used by the general public and carry a heavy volume of pedestrian or vehicular traffic"; 3. The said streets, roads or rights of way adjoin or pass through a civic area.** SECTION 2. That the City Clerk shall certify to the adoption of this Resolution. PASSED.
