HomeMy WebLinkAbout1974 024 CC RESO1974 024 CC RESO(ÌìúÏRESOLUTION NO. 74-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADOPTING REGULATIONS FOR THE PROCESSING OF ENVIRONMENTAL IMPACT REPORTS WHEREAS, the State Legislature has heretofore adopted the California Environmental Quality Act of 1970 Public Resources Code, Section 21000 et seq.) and amended State Guidelines for the implemen- tation of said Act; and WHEREAS, pursuant to" the aforesaid authority, local agencies are required to adopt regulations to implement the substantive prov- isions thereof. NOW. THEREFORE. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby adopt those certain regulations attached hereto, dated January 24, 1974, and incorporated herein as if set forth in full, as the regulations of the City of Baldwin Park for the processing of environmental impact reports. SECTION 2. The City Clerk shall certify to the adoption of this Resolution. INTRODUCTION The purpose of these regulations is to provide procedures to facilitate and encourage participation by all interested persons and agencies in the evaluation of projects as they affect the environment and to carry out the policy enunciated by the State Legislature in the Environmental Quality Act of 1970. These regulations are authorized by the Act and are in addition to the Guidelines for Implementation of the California Environmental Quality Act of 1970 promulgated by the State Resources Agency. II. PREPARATION OF ENVIRONMENTAL IMPACT REPORT A. An Environmental Impact Report EIR) shall be prepared and processed before the City issues a permit for or approves the commencement of any project, that may have or as to which there 1s» or may reasonable be, or anticipated to be, a substantial body of opinion that such project will have) a substantial adverse impact on the environment, unless it is: 1. A Ministerial as opposed to discretionary) project. 2. An Emergency Project as defined in the aforementioned Guidelines. 3. A Categorical Exemption as listed in those Guidelines. B. In preparing an EIR. the City shall seek comments from any State, County or other public agency that has jurisdiction with respect to the project and from members of the public at large. Such agencies may be school districts, water districts, flood control districts etc., that service the project site. C, In its request for comments from all agencies, the City shall describe the proposed project and advise the agency that unless the agency responds within 21 days after such request is made, it will be assumed that the agency has no comment to make. III. DISCRETIONARY, MINISTERIAL AND CATEGORICALLY EXEMPT PROJECTS A. Discretionary Projects The following are discretionary projects which require the exercise of judgment, deliberation, or decision on the part of a City boc(y or officer In approving or disapproving the activity as distinguished from ministerial acts: 1. Zone variance 2. Zone change 3. Zoning Code amendment 4. Tentative subdivision map 5. Lot splits when processed by Planning Commission 6. Encroachment permit 7. Public project 8. City acquisition or disposal of real property 9. Street vacation 10. Grading and excavation permit. 11. Conditional Use Permit 12. Ministerial Projects The Environmental Quality Act of 1970 does not apply to the following. which require action by a City body or officer based upon given facts with- out regard to judgment or opinion concerning the propriety or wisdom of the act although the ordinance or regulation may require, in some degree, a con- struction of its language, and as such are ministerial: 1. Building permit including electrical, mechanical and plumbing permits.) 2. Business license 3. Final subdivision map 4. Parcel Maps C. Categorically Exempt Projects The followiing are categorically exempt projects which exempt them from the requirements of CEQA based on the findings of the Secretary of Resources that the class of projects will not have a significant effect on the environ- ment. Class 1: Existing Facilities. Class 1 consists of the operation, repair, maintenance or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that previously existing, including but not limited to: a) Alterations, Interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances; b) Utilities. Existing facilities of both investor and publicly owned utilities used to provide electric power, natural gas^ sewerage, or other public utility services, c) Streets. Existing highways and streets within already established rights- of-way) sidewalks, gutters, bicycle and pedestrian trails, and similar facilities; d) Rehabilitation. Restoration, or rehabilitation of deteriorated or damaged structures. facilities or mechanical equipment to meet current standards of public health and safety, unless it is determined that the damage was substan- tial and resulted from an environmental hazard such as earthquake. landslide or flood; e) Additions. Additions to existing structures provided that the addition will not result in an increase of more than 50 percent of the floor area of the structures before the addition or 2500 square feet, whichever is less; f) Safety or Health Equipment. Fish Stocking by the California Department of Fish and Game. k) Condominiums. Division of existing multiple family rental units into condominiums. 1) Demolition of Buildings. Demolition and removal of buildings and related structures except where they are of historical, archaeological o^ architectural significance as officially designated by Federal. State or local government action. Class 2: Replacement or Reconstruction. Class 2 consists of replacement or reconstruction of existing structures and facilities where the new structure w111 be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced including but not limited to: a) Replacement or reconstruction of existing schools and hospitals to provide earthquake resistant structures which do not increase capacity more than 50%. b) Replacement of a commercial structure with a new structure of substantially the same size and purpose. Class 3: New Construction of Small Structures. Class 3 consists of construction and location of single, new» small facilities or structures and Installation of small new equipment and facilities including but not limited to a) Single family residences not 1n conjunction with the building of two or more such units. b) Motels, apartments, and duplexes designed for not more than four dwelling units if not In conjunction with the building of two or more such structures. c) Stores, offices, and restaurants if designed for an occupant load of 20 persons or less, if not in conjunction with the building of two or more such structures. d) Water main, sewage, electrical, gas and other utility extensions of reasonable.length to serve such construction. w i e) Accessory appurtenant) structures Including garages- carports. patios, swimming pools and fences. 3. Examples Include but are not limited to: a) Grading on land with a slope of less than 10 percent, except where it is to be located 1n a waterway, 1n any wetland. In an officially designated by Federal, State or local government action) scenic area, or in officially mapped areas of severe geologic hazard. b) New gardening or landscaping. c) Filling of earth into previously excavated land with material compatible with the natural features of the site. d) Minor alterations 1n land, water and vegetation on existing officially designated wildlife management areas or fish prod- uction facilities which result In Improvement of habitat for fish and wildlife resources or greater fish production. e) Minor temporary uses of land having negligible or no permanent effects on the environment, Including carnivals, sales of Christ- mas trees, etc. f) Minor trenching and backflTHng where the surface Is restored. Class 5: Alterations in Land Use Limitations. Class 5 consists of minor alterations 1n land use limitations, except zoning, including but not limited to: a) Minor variances, minor lot line adjustments, side yard and set back variances not resulting in the creation of any new parcel nor in any change In land use or density; b) Issuance of minor encroachment permits. Class 6: Information Collection. t^w^i^^^m nil M-»-»»»»i»——————.^»^»^——————»»—— Class 6 consists of basic data collection, research, experimental management and resource evaluation activities which do not result in a serious or major disturbance to an environmental resource. These may be for strictly information gathering purposes, or as part of a study leading to an action which a public agency has not yet approved, adopted or funded. Class 7: Actions by Reaulatory Agencies for Protection of Natural Resources Class 7 consists of actions taken by regulatory agencies as authorized by state law or local ordinance to assure the maintenance, restoration, or enhancement of a natural resource where the regulatory process involves procedures for protection of the environment. Examples Include but are not limited to wildlife preservation activities of the State Department of Fish and Game. Construction activities are not Included 1n this exemption. Class 8: Actions by Regulatory Agencies for Protection of the Environment. Class 8 consists of actions taken by regulatory agencies, as authorized by state or local ordinance, to assure the maintenance, restoration, enhance- ment. or protection of the environment where the regulatory process Involves procedures for protection of the environment. Construction activities are not included in this exemption. Class 9: Inspections. Class 10 consists of construction, or placement of minor structures accessory to appurtenant to) existing commercial. Industrial, or Instit- utional facilities, including but not limited to; a) On-premise signs; b) Small parking lots. Class 11: Surplus Government Property Sales. Class 11 consists of sales of surplus government property except for parcels of land located in an area of statewide Interest or potential area of critical concern as identified in the Governor's Environmental Goals and Policy Report of June 1. 1973. IV. NEGATIVE DECLARATION If there is no substantial body of opinion, and none is anticipated. that a non-exempt project will have a substantial adverse Impact on the environment, the attached questionnaire EXHIBIT A") shall be used to determine whether the City ma^ make a Negative Declaration EXHIBIT B"). V* NOTICES The following Notices shall be given In the time and manner specified. A. A Negative Declaration shall be posted at the City Hall at least seven 7) days before Issuance of the permit or. If the project requires a public hearing, at least seven 7) df^ys before such hearing. B. Upon preparation of an Environmental Impact Report, EXHIBIT C") a Notice of Completion EXHIBIT D-l") shall be filed with the Secretary of the Resources Agency or a Notice of Intent EXHIBIT D-2") shall be filed with the State clearinghouse. C. A Notice of Environmental Impact Report Hearing EXHIBIT E") shall be posted at the City Hall at least thirty 30) days before a public hearing on the Environmental Impact Report. The notice shall Invite public comment. It shall be given In writing to an applicant and shaTI be oubTlslied in a newspaper circulated and published in the City at least ten 10) d^ys before the hearing. If the project is a matter that requires a public hearing because it involves a Conditional Use Permit, Variance. Zone Change etc.. notice of such hearing shall include notice of the Environmental Impact Report consideration, which shall satisfy the requirements of this paragraph. D. Notice of Determination EXHIBIT F") shall be filed with the County Clerk within seven 7) days after approval or disapproval of the project Is final. If a Negative Declaration was prepared, the Negative Declaration and the Assessment of Environmental Impact Questionnaire shall be attached. VI. HEARINGS Each EIR shall be set for a public hearing before the body or officer authorized to issue the project permit. If an EIR is prepared for a project which is the subject of a public hearing, Conditional Use Permit. Zone Variance, Zone Change, etc.), the hearings may be combined. FEES A. After being notified that an EIR will be prepared, the applicant shall deposit with the City a one hundred dollar $100) fee to cover and meet all City expenses for the preparation and processing of the Environment- al Impact Report. If the EIR is a part of another Public Hearing, no fee will be charged. B. In addition, the applicant shall provide, at his cost, such information as is requested by the City to assist in the preparation of the report, and shall specify, to the best of his knowledge, the names of other public agencies that win have approval authority over the project.
