RESOLUTION OF THE COUNCIL OF THE CITY
OF BALDWIN PARK APPOINTING A SPECIAL
RECOUNTING BOARD TO RECOUNT THE BALLOTS
CAST FOR THE OFFICE(S) OF MEMBER OF THE
CITY COUNCIL AT THE GENERAL MUNICIPAL
ELECTION.
WHEREAS, a General Municipal Election was held in the City
of Baldwin Park on March 5, 1974 for the purpose of electing two 2)
Councilmen in accordance with the provisions of the State Elections
Code; and
WHEREAS, a Declaration was filed with the City Clerk on
March 11. 1974 by Candidate Russell E. Blewett in accordance with the
provisions of Section 22940 of State Elections Code alleging that because
of mistake or error, the votes cast in the precincts specified in the
Declaration were so incorrectly counted that the returns do not show
correctly which candidate received the plurality of the votes cast for
said offices;
NOW, THEREFORE, the Council of the City of Baldwin Park
does hereby resolve as follows:
SECTION 1. A special recounting board is hereby appointed
in accordance with the provisions of Section 22941 of the State Elections
Code for the purpose of publicly recounting the ballots cast at said
election in each of those precincts requested in said Declaration.
SECTION 2. Said Special Recounting Boards shall consist
of the following eight 8) voters of the City:

SECTION 3. Said Special Recounting Board shall publicly
recount said ballots in accordance with the procedure specified in
Sections 22940 through 22945 of the State Elections Code.

SECTION 4. The City Clerk is hereby directed to supervise
the work of said Special Recounting Board in accordance with Section
22941 of the State Elections Code and other applicable laws.
SECTION 5. Each member of the Special Recounting Board,
other than inspectors, shall be paid out of the City Treasury the sum
of $18 per day for each day or portion of a day served in performing
the duties and work of the Board.
SECTION 6. Before the commencement of the recount, and at
the beginning of each day following during the period of the recount,
the candidate filing the Declaration for a recount shall deposit with
the City Clerk a sum equal to one day's compensation for the members
of the Special Recounting Board, other than inspectors.
SECTION 7. Said recounting proceedings shall be conducted
in alt respects in accordance with the applicable provisions of the
State Elections Code and other applicable laws-
SECTION 8. The City Clerk is hereby directed to transmit
a copy of this resolution on the day following its adoption to each
person who was a candidate for the office of City Council at the
aforesaid General Municipal Election.
SECTION 9. The City Clerk shall certify to the adoption
of this resolution and shall cause a copy of this resolution and her
certification to be entered in the Book of Resolutions of the Council
of this City.
