HomeMy WebLinkAbout1974 082 CC RESO1974 082 CC RESO(Ììû¨RESOLUTION NO. 74-82 A RESOLUTION OF THE CITY OF BALDWIN PARK, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON NOVERMBER 5. 1974, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY AN ORDINANCE RELATING TO CREATING A COMMUNITY REDEVELOPMENT AGENCY FOR THE CITY OF BALDWIN PARK AND CONSOLIDATING SAID ELECTION WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON SAID DATE. WHEREAS, the City Council of the City of Baldwin Park did on the 3rd day of July, 1974, duly adopt Ordinance No. 684 providing for Creating a Community Redevelopment Agency for the City of Baldwin Park; and WHEREAS, the said Ordinance was duly published as required by law; and WHEREAS, pursuant to authority provided by statute a petition has been filed with the legislative body of the City of Baldwin Park signed by more than ten per cent of the number of qualified registered voters of the City of Baldwin Park protesting against the adoption of the said Ordinance hereinabove referred to; and WHEREAS, the City Clerk of the City of Baldwin Park has duly examined and from the records of registration ascertained that the petition is signed by the requisite number of voters, and has so certified; and WHEREAS, the City Council of the City of Baldwin Park has not voted in favor of the repeal of the Ordinance; and WHEREAS, the City Council of the City of Baldwin Park is thereupon authorized and directed by statute to submit the Ordinance to the qualified voters; NOW, THEREFORE, the City Council of the City of Baldwin Park. California. DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER as follows: SECTION 1. That a special election be held and the same is hereby called to be held in said city on November, 1974, for the purpose of sub- mitting to the qualified voters of said city an ordinance hereinafter set forth relating to Creating a Community Redevelopment Agency for the City of Baldwin Park. SECTION 2. That the ordinance submitted to the voters shall be as fol 1 ows: ORDINANCE NO. 684 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK CREATING A COMMUNITY REDEVELOPMENT AGENCY FOR THE CITY OF BALDWIN PARK THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Chapter 2.5 Is hereby added to Article II of the Baldwin Park Municipal Code, consisting of Section 2250. to read as follows: CHAPTER 2.5 COMMUNITY REDEVELOPMENT AGENCY" 2250. COMMUNITY REDEVELOPMENT AGENCY. That. there being a need for a redevelopment agency to function in the City, a Community Redevelopment Agency be. the same hereby is, created in and for the City of Baldwin Park. The said City Council. when acting as said Agency, shall be vested with all of the rights, powers, duties, privileges and Immunities, incident thereto, except that no member of the City Council shall receive any compensation, as such, for serving as a member of said Agency." SECTION 2. That the City Clerk shall certify the adoption of this Ordinance and cause the same to be published In the manner prescribed by law. That, thereafter, said Ordinance was duty passed and approved at a regular meeting of the City Council on the 3rd day of July, 1974, by the following vote: AYES: COUNCILMEN MC CARON. MAYOR HAMILTON. That the polls for said election shall be opened at seven o'clock A.M. of the day of said election and shall remain open continuously from said time until eight o'clock P.M. of the same day. when said polls shall be dosed, except as provided in Section 14436 of the Elections Code of the State of California. SECTION 4. That the special election hereby called for the date hereinbefore specified shall be and is hereby ordered consolidated with the statewide general election to be held on said date, and within said city the precincts, polling places and officers of election for the special municipal election hereby called shall be the same as those provided for said statewide general election. The Board of Supervisors of Los Angeles County is hereby requested to order the consolidation of the special municipal election hereby called with said statewide general election, and said Board of Supervisors is hereby authorized to canvass the returns of said special municipal election, and said elections shall be held in all respects as if there were only one election, and only one form of ballot, namely, the ballots used at said general election, shall be used. Said Board of Supervisors shall certify the results of the canvass of the returns of said special municipal election to the City Council of said city which shall thereafter declare the results thereof. A proposition submitted by this resolution shall be designated on the ballot by a letter printed on the left margin of the square containing the description of the measure, as provided in Section 10231 of the Elections Code. SECTION 7. That notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election in time, form and manner as required by law. SECTION 8. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is approved and adopted.
