A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK FORMALIZING CITY
POLICIES WITH REGARD TO OFFERS OF DEDICA-
TION FOR PUBLIC STREET PURPOSES
The City Council of the City of Baldwin Park does resolve as
follows:
SECTION 1. That the policies of the City of Baldwin Park, with
regard to the acceptance of formal offers of dedication for public street
purposes, are hereby established as follows:
a) Existing Streets. That a11 offers of dedication for
public street purposes, regardless of whether such areas are im-
proved for such purposes or not, shall be accepted by the City so
as to provide for the ultimate right-of-way width as designated
by the City Council. Where such offers of dedication are made.
but street improvements have neither been constructed nor guaran-
teed, the same shall be constructed by any one of the following
methods:
1) If required as a condition of approval imposed upon
a zone variance, conditional use permit, lot split or subdivision;
or required pursuant to Section 7004 et seq. of the Baldwin Park
Municipal Code; or required by a special assessment district pro-
ceeding; the improvements shall be at the expense of the property
owner.
2) If such an offer of dedication is made, but is not
required to be made by reason of any of the foregoing, the cost
of construction of curbs and gutters, drive approaches and paving
shall be borne by the City, as funds become available.
b) Future Streets. Offers of dedication for proposed
future streets shall be accepted only where the cost of street
improvements is borne by the property owner.
SECTION 2. That all Resolutions and findings inconsistent with
the terms and provisions of this Resolution are hereby repealed, rescinded
and revoked.
SECTION 3. That the City Clerk shall certify to the adoption of
this Resolution.
