HomeMy WebLinkAbout1975 017 CC RESO1975 017 CC RESO;¢fì÷ßRESOLUTION NO. 75-17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, URGING A CHANGE IN LAWS REGARDING THE INCARCERATION AND RELEASE OF JUVENILES CHARGED WITH FELONIES WHEREAS, the matter of juvenile crime has been brought to sharp public focus by reason of the large scale arrests of juveniles charged with the unlawful sale and possession of drugs, particularly in the area of public school systems of Los Angeles County; and WHEREAS, there has been a public outcry by reason of the fact that these minors charged with drug violations, in many instances, have been arrested and a few hours or a day later, released to their parents or guardians and are again out on the streets, where they can again engage in the various practices concerning the unlawful sale and possession of drugs, and WHEREAS, the City Council is mindful of the provisions of Section 628 of the Welfare and Institutions Code of the State of California, which gives broad powers to a Probation Officer to release a minor to his parents or guardian, in lieu of deten- tion in Juvenile Hall? and WHEREAS, public interest demands that all citizens within the State be safe from individuals, be they minors or adults, dealing in the unlawful sale of drugs within the State? NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1- That the Legislature of the State of California is hereby urged to enact laws and/or statutes which will amend the provisions of Section 628 of the Welfare and Institutions Code so that juveniles charged with crimes involving the unlawful sale and possession of drugs will not be released forthwith, at the discretion of a Probation Officer. SECTION 2. That the City Clerk is directed to send a certified copy of this Resolution to Governor Edmund G. Brown, Jr., to Senators Dills and Wedworth, to Assemblyman Leo T. McCarthy, to the Criminal Justice Committee of the Assembly, to Attorney General Evelle J. Younger, to District Attorney Joseph Busch, to Los Angeles County Sheriff Peter J. Pitchess, and to the City Council of every City in Los Angeles County- SECTION 3. That this Resolution shall take effect immediately.
