A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK ISSUING SUBPOENAS
PURSUANT TO SECTION 37104 OF THE GOVERN-
MENT CODE
WHEREAS, pursuant to the Personnel Rules of the City of Baldwin Park,
the City Manager has heretofore held a disciplinary hearing relating to
charges against Officer Randall Zink of the Baldwin Park Police Department;
and
WHEREAS, based upon the evidence presented at said hearing, the employ-
ment of Randall Zink by the City was terminated by the decision of the City
Manager on December 20, 1974; and
WHEREAS, said Randall Zink has heretofore filed an appeal from the
aforesaid decision of the City Manager, which appeal will be heard in a
personnel hearing conducted in accordance with the Personnel Rules of the
City; and
WHEREAS, the City Council is authorized by Section 37104 of the Govern-
ment Code of the State of California to issue subpoenas requiring the at-
tendance of witnesses for evidence or testimony in any such hearing or action.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY
RESOLVE:
SECTION 1. That subpoenas are hereby issued by the City Council pursuant
to the authority of Section 37104 of the Government Code requiring the attend-
ance of witnesses for the purpose of presenting testimony in the matter of the
personnel hearing of Randall Zink at a time and place to be determined.
SECTION 2. That the said subpoenas shall be signed by the Mayor and
attested by the City Clerk and may be served in the manner subpoenas are
served in civil actions in the State of California.
SECTION 3. That the City Clerk shall certify to the adoption of this
Resolution.
