HomeMy WebLinkAbout1975 042 CC RESO1975 042 CC RESO8f;¢fHöwRESOLUTION NO. 75-42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, ASSURING FUTURE COMPLIANCE WITH THE NATIONAL FLOOD INSURANCE PROGRAM The City Council of the City of Baldwin Park does resolve as follows: WHEREAS, the City of Baldwin Park has been studied by the Department of Housing and Urban Development, Federal Insurance Admini- stration, and Special Flood Hazard Boundary Maps were prepared pursuant to this study; and WHEREAS, the only areas within the city limits of Baldwin Park that were identified as Special Flood Hazard Areas were those areas situated exclusively within the limits of the improved flood control channels identi- fied on said maps as Walnut Creek Channel, Big Dalton Wash and San Gabriel River; and WHEREAS, the possibility exists that certain other areas of Baldwin Park may be subject to infrequent flooding that could cause damage to prop- erties within these areas; and WHEREAS, relief is available in the form of Federally subsidized flood insurance as authorized by the National Flood Insurance Act of 1968; and WHEREAS, it is the intent of this City Council to require the recognition and evaluation of flood hazards in all official actions relating to land use; and WHEREAS, this body has the legal authority to adopt land use and other control measures, as may be required, to further reduce the potential for flood losses pursuant to applicable general laws. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Baldwin Park hereby: 1. Assures the Federal Insurance Administration that it will enact, and maintain in force, as may be found necessary for any areas within the community having proven flood hazards, adequate land use and control measures with effective enforce- ment provisions consistent with the Criteria set forth in Section 1910 of the National Flood Insurance Program Regula- tions; and 2. Vests the Director of Public Works with the responsibility, authority, and means to: a) Delineate or assist the Federal Insurance Administrator, at his request, in delineating the limits of any such areas having proven flood hazards on available local maps of suffi- cient scale to identify the location of building sites. b) Provide such information as the Federal Insurance Admini- strator may request concerning present uses and occupancy of land areas within the community. c) Cooperate with Federal, State, and local agencies and private firms which undertake to study, survey, map and iden- tify any flood plain areas, and cooperate with neighboring communities with respect to management of any adjoining flood plain areas. Appoints the Director of Public Works to maintain for public inspection and to furnish upon request a record of elevations in relation to mean sea level) of the lowest floor including basement) of all new or substantially im- proved structures located in any proven flood hazard areas. If the lowest floor is below grade on one ftr more sides, the elevation of the floor immediately above must also be recorded. 4.
