HomeMy WebLinkAbout1975 079 CC RESO1975 079 CC RESO;¢fìöà RESOLUTION NO. 75-79 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ADOPTING A BASIC SALARY PLAN THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That attached hereto, incorporated herein by this reference, marked Exhibit A", is a Basic Salary Plan, adopted pursuant to Section 2250 of the Baldwin Park Municipal Code, relating to all positions in the City's employment which are designated and classed as Classified Nonexempt", Classified Exempt" and Unclassified Exempt" positions in such employ. SECTION 2. Nothing contained in this Resolution shall be construed as guaranteeing to any employee or official of the City any vested interest in any salary or position. SECTION 3. That all Resolutions or portions thereof, in conflict herewith are hereby repeated. SECTION 4. It is hereby expressly delcared to be the intent of the City Council to review and modify or amend this Resolution in the event the United States Supreme Court renders a decision on the case presently before it in connection with the Federal Fair Labor Standards Act, which decision might modify, confirm, or overturn said Act. SECTION 5. That this Resolution shall be in full force and effect through and including the 30th day of June, 1976, and shall thereafter be of no further force or effect. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution and shall forward a certified copy hereof to the City Manager, each Department head of the City, and the Secretary of the Personnel Board. GENERAL 1) The basic salary plan, as contained herein, relates to all positions in the City's employment which are designated as Classified Nonexempt, Classified Exempt and Unclassified Exempt Service" positions in such employ. 2) All employees, except those listed as Classified Exempt and Unclassified Exempt, shall receive overtime pay at time and one half of their regular hourly rate for all hours worked in excess of forty 40) hours actually worked during a given work week. 3) All employees listed in the Classified Exempt and Unclassified Exempt Service shall not be entitled to overtime pay, except that all hours worked in excess of forty 40) hours actually worked during a given work week shall be accrued at time and one half toward compensatory time at the discretion of the City Manager* 4) The work week of the City shall begin at 12:01 a.m. on Sunday and end 168 hours later. 5) The pay period for all employees shall consist of two calendar weeks commencing on July 1, 1975. Salaries and compensation earned shall be paid on the Friday following completion of the prior two weeks worked. When City offices are closed on the Friday payday, salaries and compensation shall be paid on Thursday. 6) Each full-time employee of the City shall accrue one day's leave with pay, per annum, which said leave shall be taken, whenever possible, on the birthdate of such employee, provided that the actual date for the use of such leave shall be within one year of said date and subject to the approval of the employee's appointing authority. 7) The basic pay rate of police officers shall be increased as listed below when assigned to the following special categories: a) Training Officer or Detective 5% of Current Basic Rate b) Training Sergeant or Detective 5% of Current Sergeant Basic Rate c) Division Lieutenant 5% of Current Basic Rate 8) The basic pay rate of police officers shall be increased as listed below upon successful completion of specialized training and education as follows: a) Intermediate P,O.S.T. Certificate 2h% of Current Basic Rate b) Advanced P.O.S.T. SALARY SCHEDULES A. Classified Nonexempt Service 1) Salaries and compensation shall be as shown in the Classified Nonexempt Service Salary Schedule in Section 3 herein. 2) The column headed Schedule Number" contains the list of schedule numbers assigned to those positions in the Classified Nonexempt Service which are subject to the provisions of the City's Municipal Code Section 2201(b) and the provisions of the Federal Fair Labor Standards Act. 3) The column headed Pay Step" contains the numerical steps for each position and schedule number listed. Step 1" represents the entry level for all positions listed. Step 2" represents the rate increase upon completion of six 6) months of satisfactory service if recommended by the appointing authority and approved by the City Manager. 4) The period of satisfactory service toward merit pay step advancement shall commence on the date of initial employment or on the date of reclassification or promotion. 5) Any employee who is reclassified or promoted to a position having a higher schedule number than the position occupied shall be paid at a rate of 2h% above the rate received when reclassified. 6) Any employee reclassified downward shall be paid at the step nearest to, but not more than, the rate of pay received prior to reclassification. B. Classified Exempt Service 1) The column headed Schedule Number" contains the list of schedule numbers assigned to those positions in the Classified Exempt Service which are subject to the provisions of the City's Municipal Code Section 2201(b) but which are not subject to the provisions of the Federal Fair Labor Standards Act. 2) Salaries and compensation shall be as shown in the Classified Exempt Service Salary Schedule in Section 4, herein. 3) The column headed Pay Step" is identical to that outlined in Section 2.A(3) of this Basic Salary Plan and shall be on the same basis as Classified Nonexempt Service. 4) The period of satisfactory service toward merit pay step advancement shall commence on the date of initial employment or on the date of reclassification or promotion. 5) Any employee who is reclassified or promoted to a position having a higher schedule number than the position occupied shall be paid at a rate h% above the rate received when reclassified or promoted. 6) Any employee in the Classified Exempt Service that is classified downward shall be paid at the step closest to, but not more than, the rate of pay received prior to reclassification. C. Unclassified Exempt Service 1) The column headed Schedule Number" contains the list of schedule numbers assigned to those positions in the Unclassified Exempt Service which are subject to the provisions of the City's Municipal Code Section 2201(c) but which are not subject to the provisions of the Federal Fair Labor Standards Act. All positions whose salaries are on a schedule number shall advance from pay step to pay step in the manner reflected in Section 2.A(3), herein, subject to the approval of the City Manager. 3) The period of satisfactory service toward merit pay step advancement shall commence on the date of initial employment or on the date of reclassification or promotion.
