HomeMy WebLinkAbout1976 015 CC RESO1976 015 CC RESO(Ììø@RESOLUTION NO. 76-15 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CONDITIONAL USE PERMIT ALLOWING THE OPERATION OF A TRUCK TERMINAL ON PROPERTY LOCATED AT 14700 BADILLO STREET. APPLICANT: TAYLORMADE TRUCKING COMPANY, INC. CASE NO. CP-224) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find and determine as follows: a) That the Planning Commission held a duly noticed public hearing on an application for a Con- ditional Use Permit to operate a truck terminal, as described in the application, together with unrelated truck and recreational vehicle parking and storage; and b) That the property to which said application relates is located at 14700 East Badillo Street, Baldwin Park, California; and c) That the decision of the Planning Commission granting said permit, was timely appealed to the City Council; and d) That the City Council conducted a duly noticed hearing upon said appeal, and based upon evidence presented, it was determined that the said application should be granted, in part, by allowing the use of the property as and for a truck terminal, as described in the application, and the applicant having requested an amendment of the application to delete that portion thereof which requested the use of unrelated truck and/or recreational vehicle parking and storage, and that it was determined that request for amendment should be, and hereby is, allowed; and e) That the findings, upon which the approval is based are as follows: 1) that the site for the proposed use has been found to be adequate in both size and shape for the proposed development; and 2) that the site has sufficient access to streets and highways, adequate in width and pavement type to carry the quantity and quality of traffic generated by this proposed use; and 3) that the proposed use has been found not have an adverse effect upon the General Plan, nor upon adjacent properties, provided that the applicant complies with the conditions of approval contained herein SECTION 2. That the Conditional Use Permit application, to 1 BIB] 37686-U01 1976-U02 015-U02 CC-U02 RESO-U02 LI3-U03 FO10488-U03 FO11012-U03 DO11258-U03 C6-U03 RESO-U03 3/5/2003-U04 ROBIN-U04 1976 015 CC RESO(Ììø@Resolution No. 76-15 allow the construction and maintainence of a truck terminal, be, and hereby is, approved, subject to the following conditions: a) That a Development Plan, including required landscaping and irrigation, shall be submitted to the Planning Department subject to a Precise Plan Review prior to occupancy and within six weeks from and after the adoption hereof; and b) That the development shall conform to the following conditions: 1) all exterior lighting be equipped with light hoods and directed away from residential uses and public right-of-way; and 2) a six 6) foot high view-obscuring fence be placed and maintained along the entire length of the easterly property line of Lot #10 to visually protect the existing rear yards of the residences on Virginia Avenue; and 3) the hours of operation shall be limited to the hours between 6:00 a.m. and 10:00 p.m., Monday through Friday, as the maximum hours of operation; and 4) that full width sidewalks, matching exist- ing sidewalks, shall be constructed on all street frontages, to wit: 8 feet in width; and 5) six trees shall be planted and maintained; and 6) if the applicant does not modify the exist- ing traffic signaling system at the intersection of Badillo Street and Ramona Boulevard, the gate facing that intersection shall remain permanently closed and the use of that driveway prohibited; and 7) all on-site utilities shall be underground; and 8) that any and all storage shall be located on the site so as not to be visible from the street; and 9) that off-street vehicular parking for trucks and passenger cars shall be permitted, but the use of all such off-street parking facilities shall be limited to those vehicles which are in direct use as a part of the truck terminal-warehousing operation, and no portion of the parking facilities shall be made available for parking or storage of unrelated vehicles, with or without a charge therefor. c) That the applicant execute and file on a form approved by the City Attorney a covenant to hold Lots #6 and #10 as a single parcel. d) That the existing roof sign on the subject property be removed before April 1, 1976. e) That the property owner shall comply with all conditions of approval as stated in this resolution, BIB] 37686-U01 1976-U02 015-U02 CC-U02 RESO-U02 LI3-U03 FO10488-U03 FO11012-U03 DO11258-U03 C6-U03 RESO-U03 3/5/2003-U04 ROBIN-U04 1976 015 CC RESO(Ììø@Resolution No. 76-15 within a time limit as not to exceed six 6) months, or the approval given for; this Conditional Use Permit may be subject to revocation pursuant to Section 9483 of the Baldwin Park Zoning Ordinance. SECTION 3. That the City Clerk shall certify to the adoption of this resolution, and forward copies hereof to the applicant and to the Secretary of the Planning Commission PASSED and APPROVED this 3rd day of March 1976.
