HomeMy WebLinkAbout1976 016 CC RESO1976 016 CC RESO(ÌìøDRESOLUTION NO. 76-16 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A MINOR VARIANCE APPLICATION LOCATION: 4222 & 4228 BOGART AVE.; APPLICANT: LARRY KOOPMANS; CASE NO. MV-40-B) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find and determine as follows; a) That the Planning Director held a hearing on the application for a minor variance to allow development of property in Zone R-3, with less than the required side yard set back; and b) That the property to which said minor variance relates is located at 4222 & 4228 Bogart Avenue, in the City of Baldwin Park, County of Los Angeles, State of California, more particularly described in the Planning Department's case file; and c) That the Planning Director determined that the minor variance should be granted; and d) That a timely appeal was taken, appealing the decision of the Planning Director to the City Council; and e) That after conducting a hearing upon said matter, and each member of the Council being familiar with the site, the Council deter- mined that the facts required by Section 9471 of the Baldwin Park Municipal Code were present, and that granting said minor variance would not adversely affect the General Plan, and adjacent and surround- ing properties; and f) That access to the rear yards of these 50 foot lots is necessary to provide full use of the property and protect the aesthetic quality of the neighborhood; and g) That other properties in the area are constructed less than 5 feet from the property line. SECTION 2. That the minor variance application above referred to is hereby approved, subject to the following conditions: a) That the property be developed substantially as shown on the plot plan. b) That a 30" high masonry or plaster wall be built parallel to the street as an extension of the garage wait to the edge of the driveway. c) That the property owner shall comply with all conditions of approval as stated by this resolution within a time limit of not to exceed six 6) months, unless otherwise noted therein, or the approval given for the variance may be subject to revocation pursuant to Section 9483 of the Baldwin Park Zoning Ordinance. SECTION 3. That the City Clerk shall certify to the adoption hereof, and forward a certified copy of this resolution to the applicant and to the Planning Director.
