A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK AUTHORIZING
APPROPRIATE OFFICERS OF THE COUNTY OF
LOS ANGELES TO CANCEL CERTAIN TAXES
AND ASSESSMENTS OF THE CITY WITHOUT
THE CONSENT OF THE CITY ATTORNEY OR
OTHER OFFICER OF THE CITY
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS
FOLLOWS:
SECTION 1. Revenue and Taxation Code Section 4986 of the State of
California heretofore provided that no cancellation of any tax or penalties
or costs attached thereto, collectable by County officers on behalf of a city,
may be made on the ground that such tax was erroneously or illegally levied
or charged, without the written consent of the city attorney of the city
concerned. Said Revenue and Taxation Code Section 4986 has now been amended
to provide that the written consent of the city attorney need not be obtained
if the City Council, by resolution filed with the Board of Supervisors, has
authorized cancellation by the appropriate County officers.
SECTION 2. The City Council finds that at the present time no
useful purpose is served by requiring the written consent of the City Attorney
for such cancellation in that the appropriate County officers have the
requisite expertise and the necessary knowledge of the facts with respect to
such assessments or charges to effectuate such cancellations.
SECTION 3. The appropriate officers of the County of Los Angeles are
hereby authorized to cancel any tax, and any penalties or costs attached thereto,
on the grounds specified in Revenue and Taxation Code Section 4986 a) 2).
without the written consent of the City Attorney or other officer of the City
of Baldwin Park. This authorization shall remain effective until rescinded by
the City Council and notice of such rescission to the Board of Supervisors of
Los Angeles County.
SECTION 4. The City Clerk is hereby authorized and directed to certify
and file a copy of this Resolution with the Board of Supervisors of Los Angeles
County.
