HomeMy WebLinkAbout1976 043 CC RESO1976 043 CC RESO(Ììø RESOLUTION NO. 76-43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DETERMINING THAT A NUISANCE EXISTS UPON CERTAIN REAL PROPERTY IN THE CITY OF BALDWIN PARK IN VIOLATION OF SECTION 7600 OF THE BALDWIN PARK MUNICIPAL CODE 76-N-4) WHEREAS, pursuant to the provisions of Section 7602 of the Baldwin Park Municipal Code a notice was given to Ms. Eugenia Igna that certain property in the City of Baldwin Park, owned hy her. would be the subject of a hearing before the City Manager on April 19, 1976 at 2:30 p.m. to determine whether said property should be declared a public nuisance pursuant to Section 7600 of the Baldwin Park Municipal Code. A copy of the notice, dated April 6, 1976, is attached hereto and made a part hereof, marked Exhibit A. Said notice contains the street address and legal description of the subject property, and WHEREAS, a hearing was held on April 19. 1976 at 2:30 p.m. before the Acting City Manager of the City of Baldwin Park at the Council Chambers. City Hall. 14403 East Pacific Avenue. Baldwin Park, California; neither Ms. Eugenia Igna nor her repre- sentative appeared at said hearing although they received notice of same, and, WHEREAS, subsequent to said hearing on April 19. 1976. and after being fully advised in the premises, the Acting City Manager determined and declared that the aforementioned property was a public nuisance; in the course of said hearing testimony was received from Richard Cunningham, Building Regulations Supervisor. and an inspection report of an inspection held on March 9, 1976, covering the subject property, was entered into the record of proceedings; said inspection report is attached hereto and made a part hereof marked Exhibit B. and WHEREAS, it was the testimony of Richard T. Cunningham that all of the deficiencies listed in the inspection report should be corrected by a licensed contractor within thirty 30) days, that the County be called to suspend the operating permit, that the apartment units be rehabilitated and returned to motel units, and if owner continues to operate and does not rehabilitate, that a court order be requested to provide for compliance; a notice of the proceedings at the hearing before the City Manager together with the ruling of the City Manager was thereupon served by mail upon Ms. Eugenia Igna by notice dated April 19, 1976; a copy of said notice is attached hereto and made a part hereof marked Exhibit C. and, WHEREAS, pursuant to the provisions of Baldwin Park Municipal Code Section 7606 the Respondent appealed the decision of the City Manager to the City Council; said appeal was heard by the City Council of the City of Baldwin Park at its regular meeting of May 19, 1976; Respondent appeared personally and through her attorney, George Kasem; testimony was received at the hearing from Richard T. Planning Director, Virgil Igna and Tom Carpenter; the inspection report, attached hereto as Exhibit B. a cover letter to Respondent dated March 19, 1976, a report from the County Health Department dated May 3, 1976. and certain slides shown to the City Council by Mr. Cunningham were introduced into evidence and made a part of the record; the cover letter dated March 19. 1976 is attached hereto and made a part hereof marked Exhibit D and the County Health Department report is attached hereto and made a part hereof marked Exhibit E. NOW, THEREFORE, the City Council of the City of Baldwin Park does hereby find, determine and resolve as follows: SECTION 1. The aforementioned proceedings were taken in accordance with the provisions of the Baldwin Park Municipal Code. SECTION 2. Respondent. Eugenia Igna. was afforded a full and fair hearing. SECTION 3. The City Council has been fully advised in the premises. SECTION 4. The City Council hereby finds and determines that the inspection report submitted in evidence on these premises referring to an inspection on March 9, 1976. and containing approx imate-ly 16 pages is substantially correct and that a nuisance as defined in the Municipal Code does exist upon those premises and must be abated, and that the property owner is granted until June 18, 1976 in which to abate the nuisance as spelled out in the inspection report and to obtain the necessary permits and do the necessary work to abate that nuisance, and if the property owner diligently proceeds with the work, and if prior to June 18. 1976 requests an extension, the City Council will consider such a request and will grant same, providing the work is progressing satisfactorily and diligently, to the satisfaction of the Building Department. SECTION h)lj4) i *•——'— Uhenever a building or structure, used or intended to be used for dwelling purposes, because of inadequate maintenance, dilapidation, decay, damage, faulty construction or arrangement, inadequate light, air, or sanitation facilities, or otherwise, is determined by the Health Officer to be unsanitary, unfit for human habitation or in such condition that is likely to cause sickness or disease. Specific conditions alleging violation of the above code sections and the required corrections for abatement are so noted in the inspection report of March 9, 1976. In the event the City Manager declares that a public nuisance exists, it will be the responsibility of the property owners or persons having legal interest in the property to abate the nuisance within the time specified by the City Manager. Should the nuisance not be abated within the prescribed time then the City may abate the nuisance by demolition or such other method as may be prescribed by law, and charge the cost thereof against the property or it's owner. Garvey Avenue, Baldwin Park On March 9, 1976, an inspection was made of the above subject trailer park known as Wolverine No. 2 owned by Mrs. Eugenia Igna, 12819 E. Garvey Ave- nue, Baldwin Park. Members of the inspecting party were, John Ford, Manager of the Park, Richard Cunningham, Building Regulations Supervisor, Juan Minjares, Building Inspector, Philip Kitgour, Planning Director, Lanny Snyder, Administrative Analyst Planning Department and Jim- Rogers, Planning Technician Planning Department. Efficiency Dwelling Units A review of records on file indicate that the property was first developed as an auto court in 1944, consisting of a store-dwelt inc|, two 18 by 32 foot buildings, housing 2"two room auto courts. Permits show there was four buildings on the property. First indications of the existence of a trailer park was in 1947. State Trailer Park Permit No. 1960 was listed on a building permit to construct a laundry and shower facility for an existing trailer park. A building permit was issued in 1964 to alter an existing building into four motel units. It is assumed this building to be the store-dwelling. There are no permits on file for any further alterations or modifications. Inspections show that a11 motel units have been illegally coverted to twelve 12) efficiency dwelling units. These converted units did not at the time of conversion or at present meet minimum code requirements as dwelling units. Following is a list of deficiencies found in those units inspected. It is assumed the other units are in a tike condition. Units 1 through 12 a. Illegally converted to an apartment. 1. Remove kitchen facilities from wardrobe and install shelf and pole. b.
