HomeMy WebLinkAbout1976 077 CC RESO1976 077 CC RESO;¢fìö"peRESOLUTION NO. 76-77 A RESOLUTION OF THE BALDWIN PARK CITY COUNCIL APPROVING A MODIFICATION OF RESOLUTION 76-15 TO ADD RECREATIONAL VEHICLE PARKING TO AN EXISTING TRUCK TERMINAL ON PROPERTY LOCATED AT 14700 BADILLO STREET. APPLICANT: TAYLOR- MADE TRUCKING COMPANY, INC. CASE NO. CP-224) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find and determine as follows: a) That the Planning Commission held a duly noticed hearing on a Modification of Resolution 76-15 for a Conditional Use Permit to add recreational vehicle parking to the existing truck terminal; and b) That the property to which said application relates is located at 14700 East Badillo Street, Baldwin Park, California; and c) That the applicant requested a Modification of the permit granted on Resolution 76-15; and d) That the City Council conducted a duty noticed hearing upon said request for Modification and b^sed on the evidence presented, it was determined that the said dpptication should be granted by allowing the use of the property as and for a truck terminal with the addition of the recreational vehicle parking, and that it was determined that the Modification should be, and hereby is, allowed; and e) That the findings, upon which the approval is based are as follows: 1) that the site for the proposed use has been found to be adequate in both size and shape for the proposed development; and 2) that the site has sufficient access to streets and highways, adequate in width and pavement type to carry the quantity and quality of traffic generated by this proposed use; and 3) that the proposed use has been found not to have an adverse effect upon the General Plan, nor upon adjacent properties, provided that the applicant complies with the conditions of approval contained herein. SECTION 2. That the Modify ti OP f Resolution 76-15 to add recreational vehicle parking to an ex-.st'ng truck tern-.nal, be, and hereby is, approved, subject to the following conditions: a) That a11 exterior lighting shall be equipped with hoods and directed away from a11 adjacent residential uses and from the public right-of-way; and b) That a11 fencing along the west, north and east property tines of the subject property be a minimm;: of six 6*) feet in height. Such fencing shall be used to screen ar^ dnrt all recreational vehicle and outside storage areas; and BIB] 37685-U01 1976-U02 077-U02 CC-U02 RESO-U02 LI3-U03 FO10488-U03 FO11012-U03 DO11020-U03 C6-U03 RESO-U03 3/4/2003-U04 ROBIN-U04 1976 077 CC RESO;¢fìö"peResolution No. 76-77 Page 2 c) That the hours of operation for the truck terminal shall remain from 6:00 a.m. to 10:00 p.m. However, the hours of operation for the recreational vehicle parking shall be allowed, during the first six month period, on a 24-hour basis. The Planning Department shall review, during this period, any and all noise complaints generated by the addition of recreational vehicle parking. After this six month period, modifications of the hours of operation shall be proposed to the Planning Commission; and d) That a landscape and irrigation plan shall be required for all areas where landscaping is providing a view obscuring fence. Where necessary, new landscape plant material will be designated to be planted. All existing landscaping and planter boxes will also be required to be maintained. Additionally, adjacent to the sidewalk along both Badilto Street and Downing Avenue, a three 3') foot side planter area is to be developed and maintained. This planter area is to be provided with approved street trees forty 40) foot on center, beginning forty 40') feet west of the westerly palm tree along Badillo Street. Landscaping responsibilities within both private and public property along the perimeter of the property will be clarified during the Precise Plan Review processi and e) That the following requirements of the Public Works Department shall be provided or suitably bonded for before implementation of the proposed use: 1) That ail utilities are to be underground; and 2) That if the appticdnt uoes not modify the existing traffic signaling system at the intersection of Baditio Street and Ramona Boulevard, the gate facing the intersection must remain permanently closed and the use of the driveway prohibited; and f) That any and a11 storage shall be located behind a view obscuring fence so as not to be visible from any street; and g) That any and all storage of combustible fuels and materials must be done in accordance to a11 applicable agencies; and h) That all parking requirements be completed and maintained. This includes employee and customer parking stalls; and i) That the applicant and/or property owner shall execute and file a Covenant and Agreement binding lots #6 and 10 as a single parcel; and j) That the property shall be kept clean of debris and weeds; and k) That a six 6') foot high masonry trash enclosure with view obscuring gates be provided; and 1) That a11 signs are to be approved before occupancy; and m) That all mechanical equipment shall be screened from view; and n) That a11 existing and proposed fencing material shall be maintained; and o) That a six 6*) foot high block wall shall be required along the east property line adjacent to residentially zoned properties within two years of the adoption date of a City Council Resolution approving the Modification of CP-224; and BIB] 37685-U01 1976-U02 077-U02 CC-U02 RESO-U02 LI3-U03 FO10488-U03 FO11012-U03 DO11020-U03 C6-U03 RESO-U03 3/4/2003-U04 ROBIN-U04 1976 077 CC RESO;¢fìö"peResolution 76-77 Page 3 p) That a property development plan shall be submitted to the Planning department for a Precise Plan Review to include, but not be limited to, conditions a) through o), before the issuance of any new" construction building permits; and q) That the applicant and/or property owner shall sign an affidavit within fifteen 15) days after the adoption of the Resolution that he has read and accepts all the conditions of approval; and r) That all conditions herein shall be fully applicable to any successors in interest, heirs, and assigns of the applicant and/or property owner; and s) That the applicant and/or property owner shall comply with all the conditions of approval as stated by the Resolution within a time limit not to exceed six 6) months, unless otherwise noted herein, or the approval given for the Conditional Use Permit Modification may be subject to revocation pursuant to Section 9483 of the Baldwin Park Zoning Code. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution, and forward copies hereof to the applicant and to the Secretary of the Planning Commission.
