HomeMy WebLinkAbout1976 096 CC RESO1976 096 CC RESO;¢fìöMpeRESOLUTION NO. 76-96 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A REDEVELOPMENT PLAN REPORT RELATING TO THE PROPOSED SAN GABRIEL RIVER REDEVELOPMENT PROJECT; AND APPROVING AN ENVIRONMENTAL IMPACT REPORT CONTAINED THEREIN WHEREAS, the Community Redevelopment Agency of the City of Baldwin Park Agency") has prepared a Redevelopment Plan for the San Gabriel River Redevelopment Project Redevelopment Plan"); and WHEREAS, a duly noticed Joint Public Hearing was conducted on November 23, 1976 and continued to November 30, 1976, by this City Council and the Agency as provided by law, and a full and fair public hearing was held; and WHEREAS, Agency has submitted a Redevelopment Plan Report and an Environmental Impact Report upon said Redevelopment Plan; and WHEREAS, Agency adopted its Resolution entitled: A Resolution of the Community Redevelopment Agency of the City of Baldwin Park Approving Certain Revisions to the Proposed Redevelopment Plan and the Report to the City Council and Recommending Adoption of the Redevelopment Plan as Revised to the City Council and Requesting Concurrence In said Revisions by the Planning Conrolsslon"; and WHEREAS, transmitted with said Resolution was a Revised Report upon the Redevelopment Plan pursuant to Section 33352 of the Health and Safety Code, a Planning Report, an Economic Impact Analysis, a Market Support Analysis, the Relocation Plan and the Draft Environmental Impact Report with revisions; and WHEREAS, the Agency also transmitted the Revised Redevelopment Plan and the Revised Report to the Planning Commission; and WHEREAS, in response to the request of the Agency, the Planning Commission adopted its Resolution entitled: A Resolution of the Planning Commission of the City of Baldwin Park Reporting on a Revised Redevelopment Plan for the San Gabriel River Redevelopment Project Area and Recommending that the City Council Approve and Adopt said Revised Redevelopment Plan"; and WHEREAS, said above-mentioned Resolution of the Planning Commission was transmitted to the Agency and this City Council; and WHEREAS, the EIR was offered to review as authorized and directed by the Agency and this City Council; and WHEREAS, all comments received have been reviewed and answered when appropriate and incorporated in said EIR; and WHEREAS, pursuant to notice duly given, the Agency and this City Council have held a full and fair public hearing on such EIR and are futty advised in the premises; and BIB] 37685-U01 1976-U02 096-U02 CC-U02 RESO-U02 LI3-U03 FO10488-U03 FO11012-U03 DO11039-U03 C6-U03 RESO-U03 3/4/2003-U04 ROBIN-U04 1976 096 CC RESO;¢fìöMpeResolution No. 76-96 Page 2 NOW, THEREFORE. BE IT RESOLVED, DETERMINED AND ORDERED BY THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AS FOLLOWS: SECTION 1. The City Council hereby approves the EIR, which is part of said Redevelopment Plan Report. SECTION 2. This City Council hereby approves the Redevelopment Plan Report, transmitted by the Agency. SECTION 3. This City Council hereby certifies that: i) the EIR has been completed in compliance with the California Environmental Quality Act, Public Resources Code Section 21000, et seq., and 14 California Adminis- trative Code Section 15000, et seq., ii) this City Council has reviewed and considered the information contained in said EIR. SECTION 4. The Redevelopment of the area, pursuant to said Redevelop- ment Plan, will have an effect on the environment. The Environmental Impact Report identifies possible adverse environmental consequences in the area of energy consumption, air quality, the effect upon vegetation and wildlife, noise, traffic circulation, demand for public services and utilities, increase in potential rainfall runoff and the loss of certain open space. The City Council finds and determines that based upon the Environmental Impact Report and the supporting data none of the potential adverse environmental consequences would have a significant adverse effect upon the environment. The effect upon wildlife and vegetation will be minimal, the increase in the number of persons working within the project will In some cases reflect a movement of personnel from one part of the local environment to another and in any event the development wilt take place within an area already designated by the City for Industry and an area which is able to absorb additional industrial activity without impact- ing significantly upon surrounding areas. The potential impact of noise is indicated by the Environmental Impact Report to be minimal because it wilt be confined within the Industrial area itself. The Environmental Impact Report Indicates that air quality wilt not be significantly impacted by the additional pollutants which will be generated by the industrial activity and related traffic within the project area. The report further indicates that although traffic circulation and activity will increase, the plan calls for the expansion of streets necessary to handle that traffic and no impact will be found in the adjacent residential areas as a result of increased traffic. The report indicates that there will be additional burdens upon the Police Department and a slight increase upon the Fire Department which will not require the creation of additional facilities by the Fire Depart- ment. The project win generate sufficient additional income and economic activity to pay for the cost of additional services without impacting the balance of the community or their ability to provide municipal services. The project win create additional demands for energy, however, it appears to the City Council that in the total energy picture in the County of Los Angeles there win be a miniscule increase and appropriate energy saving procedures, some of which are pointed out in the report, will reduce the energy Impact to an insignificant level. Although some open space win be lost it 1s presently visually unattractive and obviously underdeveloped. The development of the area will, on balance, provide an improvement to the general aesthetics of the area and the loss of open space will have a minimal effect upon the environment generally. The report indicates that the potential rainfall runoff and generation of storm water can be adequately handled with present and planned drainage facilities. Even if one or more of the potential Impacts discussed in the report or referred to in this Resolution were determined to be significant within the meaning of the Environmental Quality Act, this City Council finds and determines that there are overriding considerations which require this project to proceed in any event. The project win clean up a blighted and visually unattractive portion of Baldwin Park which has failed to achieve its potential for productivity and has failed to generate a reasonable and adequate tax revenue to support itself because of the unwilligness or inability of private owners or investors to develop the area. It is essential to the overall well being of the community that blighted portions of the community be made productive and jobs provided to its citizens. The City Council finds no environ- mental consideration in this project which could be sufficiently significant to override the community obligation to proceed with this Redevelopment Project. SECTION 5. The City Council hereby approves the Redevelopment Plan, as revised. SECTION 6. The City Clerk shall certify to the adoption of this Resolution and is hereby authorized and directed to file with the County Clerk of the County of Los Angeles a Notice of Determination together with a copy of this Resolution.
