HomeMy WebLinkAbout1977 011 CC RESO1977 011 CC RESO(ÌìôïpeRESOLUTION NO. 77-11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING PERSONNEL RULES ADOPTED BY RESOLUTION NO. 75-4 WHEREAS. Section 12.4 of the Personnel Rules authorizes an employee against whom disciplinary action has been taken to appeal the decision to the Personnel Commission; and WHEREAS, the Personnel Commission is exercising the function of con- ducting disciplinary proceedings on behalf of the City Council; and WHEREASs the proceedings before the Personnel Commission in disci- plinary matters effect important property rights of the employees entitling them due process of law; and WHEREAS, the power to compel the attendance of witnesses on their behalf and on the City's behalf is an important ingredient of due process and should be afforded at the earliest possible time in the disciplinary proceeding. NOW, THEREFORE, the City Council of the City of Baldwin Park does hereby resolve as follows: SECTION 1. The second paragraph of Section 12.5 is hereby amended by adding thereto the following language: The Personnel Commission shall upon request of the employee, the appointing authority, or the City Manager and upon a showing of good cause issue subpoenas for the purpose of compelling the attendance of prospective witnesses at hearings before the Personnel Commission or for the taking of depositions of prospective witnesses before a certified Court Reporter." SECTION 2. That the City Clerk shall certify the adoption of this Resolution and forward certified copies hereof to the City Manager, each department head of the City, Secretary of the Personnel Commission and to authorized representatives of each recognized employee organization designated as such by the City.
