THE CITY COUNCIL OF THE CITY OF BALDWIN PARK RESOLVES AS FOLLOWS: SECTION 1. Resolution No. 75-27, which established regulations for processing environmental impact reports is hereby repealed. SECTION 2. That those certain documents, attached hereto as Exhibit A" are hereby adopted as the City's Regulations for Processing Environmental Impact Reports. SECTION 3. GENERAL SCOPE SECTION 1.000 Authority. The Guidelines adopted by the Baldwin Park City Council implement the requirements of the California Environmental Quality Act CEQA) as amended. SECTION 2.000 SECTION 3.000 SECTION 4.000 SECTION SECTION 5.000 6.000 Purpose. The purpose of these Guidelines is to set forth procedures, principles, objectives, and criteria. These Guidelines are intended to be procedural, and are to be construed in conformity with CEQA and State Environmental Impact Report Guidelines. Early Preparation. Environmental documents should be prepared as early as feasible in the planning process to enable environmental considerations to influence project program and design. ARTICLE II. GENERAL RESPONSIBILITIES Adoption of Guidelines. These Guidelines have been officially adopted by the City Council of Baldwin Park. The City Council shall require changes to these Guidelines in response to future CEQA amendments and revisions to the State Environmental Guidelines. Consultation. The Lead Agency shall consult with alt responsible agencies before completing a Draft EIR of Negative Declaration. Environmental Documents Combined with Existing Planning and Review Process. To the extent feasible, the environmental review process should be coordinated with the existing planning review and project approval process. The sponsoring city department should include the environmental documents as a part of the regular project report. SECTION 7.000 Fees and Charges. A. The City may charge and collect a reasonable fee to cover actual expenses from such person or entity in order to recover the estimated costs incurred in preparing and reviewing environmental documents. The fee for processing an Assessment for Environmental Impact is as determined by City Council resolution. B. The city department processing a project is granted authority to contract with consultants for the preparation of a Draft EIR at the request of the applicant This fee will be in addition to all other applicable fees, and the consultant fee shall be determined by bid proposal submitted to the City and the applicant. C. The City may charge and collect a fee for the actual cost of reproducing a copy of an environmental document requested by a public agency or private individual. EXEMPT PROJECTS SECTION 8.000 Projects Exempt from Environmental Review and Notice of Exemption. A Notice of Exemption is a brief notice which may be filed when a public agency has determined that the project is exempt from CEQA requirements. This exemption occurs when the project is ministerial, categorically exempt, or an emergency project. A. Ministerial Projects. Activities for which the discretion of the public agency is limited and generally preclude the opportunity for denial or the setting of conditions for approval. A ministerial decision involves only the use of fixed standards or objective measurements without personal judgement. By action of the City Council, the following actions are, in most cases, deemed ministerial in nature: 1). Temporary occupancy permits. 2). Approval of minor variances. 3). Issuance of grading permits. B. Emergency Projects. Activities undertaken to prevent or lessen an emergency including maintenance, repair, restoration, demolition or replacement of property or facilities. C. Categorically Exempt Projects. Activities exempted from CEQA based on the generic character of the activity reflect categories" or classes" of activities which will not have a significant adverse effect on the environment. Presently there are 20 classes of projects which are categorically exempt from CEQA and for which Notices of Exemption may be filed: Class 1 Operation, repair and maintenance of existing facilities. Class 2 Replacement or reconstruction of existing facilities. Class 3 New construction of snail structures. Class 4 Minor alterations to land. Class 5 Alterations in land use limitations. Class 6 Collection of information. Class 7 Actions by regulatory agencies for the protection of natural resources. Class 8 Actions by regulatory agencies for the protection of the environment. Class 9 Inspections. Class 10- Loans. Class 11- Accessory structures. Class 12- Surplus government property sales. Class 13- Acquisition of lands for wildlife. lasj? 14-.Mnor Additions—to_ schools. PROJECT REVIEW AND EVALUATION SECTION 9.000 Genera] Statement. This Article establishes the procedures for filing projects for environmental review, the procedures and criteria for performing project evaluation, and the decision making process for determining the significance of a project. Unless it can be seen with certainty that there is no possibility that the activity, either individually or cumulatively, may have a significant effect on the environment, environmental documents must be prepared and reviewed. SECTION 10.000 Procedures for Initiating Environmental Review. A. For each activity identified as a project" the applicant shall file an applicant's Environmental Information form with the City. B. Upon receipt of the Applicant's Environmental Information form, the City shall complete an Assessment for Environ- mental Impact. These forms together shall constitute an initial study, which, when completed shall establish information to make the following determinations: 1. The project is categorically exempt. 2. A Negative Declaration is required. 3. An Environmental Impact Report is required. ARTICLE V. NEGATIVE DECLARATION PROCEDURES SECTION 11.000 Negative Declaration Procedures. A Negative Declaration shall be prepared where it is found, on the basis of an initial study, that there is no possibility of a significant adverse effect on the environment. Before completing a Negative Declaration, the lead agency shall consult with all responsible agencies affected by the project. SECTION 12.000 Public Notice for Negative Declaration, Notice of the preparation of a Negative Declaration shall be.provided to the public within a reasonable period of time prior to final adoption by the public agency of the Negative Declaration. Notice shall be given to all organizations and individuals who have previously requested such notice and shall also be given by at least one of the following procedures. A. Publication, no fewer times than required by Section 6061 of the Government Code, by the public agency in a newspaper of general circulation in the area affected by the proposed project. B. Posting of notice by the public agency on and off site in the area where the project is to be located. C. Direct mailing to owners of property contiguous to the project. D. The alternatives for providing notice specified herein shall not preclude a public agency from providing additional notice by other means if such agency so desires, nor shall the requirements of this section preclude a public agency from providing the public notice otherwise required by law for such a project. SECTION 13,000 Notice of Determination for a Negative Declaration. A. After an approval, or conditional approval by the City on a project for which a Negative Declaration was prepared, the City shall file a Notice of Determination with the Los Angeles County Clerk. If the project required discretionary approval from a state agency, the Notice of Determination shall also be filed with the Secretary for Resources of the State. ARTICLE VI. ENVIRONMENTAL IMPACT REPORT PROCEDURES SECTION 14.000 SECTION 15.000 General Statement. If after an initial study, it can be fairly argued on the basis of substantial evidence that there may be a significant adverse effect on the environment, or there is a serious public concern, the City must prepare, or cause to be prepared, an EIR. EIR Public Notice. After completing a draft EIR, the Lead Agency shall consult with and obtain comments from public agencies having jurisdiction by law with respect to the project and should consult with persons having special expertise with respect to any environmental impact involved. The City shall provide the general public with an opportunity to comment on the EIR. A. The City shall provide public notice of the completion of a draft EIR at the same time as it sends a Notice of Completion to the Resources Agency. Notice shall be given to all organizations and individuals who have previously requested such notice and shall also be given by at least one of the following procedures: Publication no fewer times than required by Section 6061 of the Government Code by the public agency in a newspaper of general circulation in the area affected by the proposed project. SECTION 16.000 SECTION 17.000 The alternatives for providing notice specified herein shall not preclude a public agency from providing additional notice by other means if such agency so desires, nor shall the requirements of this section preclude a public agency from providing the public notice required by this section at the same time and in the same manner as public notices otherwise required by law for such project. B. General Statement. Environmental Impact Reports shall contain the information outlined in CEQA and the State EIR Guidelines. Each element must be covered, and when these elements are not separated into distinct sections, the document shall state where in the document each element is discussed. Preparation of an EIR. The City shall require an applicant to submit data and information necessary to enable the City to prepare the EIR. This information shall be transmitted using the Information Data Sheet" provided. As an alternative the City may cause the preparation of EIR's utilizing consultants. A 11st of consultants that have Indicated an ability to prepare EIR's w111 be developed by the City. From this list, the project applicant will designate three consulting firms he would tike to consider, or the applicant may submit the name of his own EIR contractor to be considered. All consultants will submit a proposal on the project. The consultant's fee as deposited with the City will be paid to the consultant in accordance with the terms of the contract between the City and the consultant. In order to prevent any possible conflict of interest, and to preserve objectivity, the City win not consider utilizing any consulting firm that is associated with the project under consideration. ARTICLE VII. PROCEDURES FOLLOWING COMPLETION OF THE DRAFT EIR SECTION 18.000 Notice of Completion. As soon as the draft EIR is completed the public must be notified and a Notice of Completion must be filed with the State Clearinghouse. The notice shall include a brief description of the project, its proposed location, an address where copies of the EIR are available, and the period during which comments will be received. A form for the Notice of Completion is provided herein. SECTION 19.000 Adequate Time for Review and Comment. The period during which comments will be received on EIR's shall remain open until certification of the final EIR is made by the decision-making body; but in no case shall the review period be less than thirty 30) days. Where state review is required a min-tmum of forty five 45) days shall be observed unless a shorter period is approved by the State Clearinghouse. ARTICLE VIII. PREPARATION AND CERTIFICATION OF FINAL EIR SECTION 20.000 General Statement. The purpose of this Article is to define the procedures for completion of the final EIR by the City and the certification of the final EIR by the appropriate decision- making body. SECTION 21.000 Contents of the Final EIR. The final EIR shall consist of: A. The preliminary EIR; B. The minute record(s) of the recommending and/or decision- making body or; C. Comments and recommendations, received, either verbatim or in summary; D. A list of persons, organizations and public agencies commenting on the document; E. The responses to significant environmental points raised in the review and consultation process. SECTION 22.000 Findings. A. No public agency shall approve or carry out a project for which an environmental impact report EIR) has been completed which identifies one or more significant effects of the project unless the public agency makes one or more of the following written findings: BIB] 37685-U01 1977-U02 016-U02 CC-U02 RESO-U02 LI3-U03 FO10488-U03 FO10862-U03 DO11063-U03 C6-U03 RESO-U03 3/4/2003-U04 ROBIN-U04 1977 016 CC RESO8f;¢fHõ'pe1). Changes or alterations have been required 1n, or incorporated into, the project which mitigate or avoid the siqnificant environmental effects thereof as identified in the final EIR. 2). Such changes or alterations are within the responsi- bility and jurisdiction of another public agency and not the agency making the finding. Such changes have been adopted by such other agency or can and should be adopted by such other agency. 3). Specific economic, social, or other considerations make infeasible the mitigation measures or project alternatives identified in the final EIR. B. The findings required by subsection A) shall be supported by substantial evidence in the record. C. The finding in subsection A.2) shall not be made if the agency making the finding has concurrent jurisdiction with another agency to deal with identified feasible mitigating measures or alternatives. SECTION 23.000 Notice of Determination for an EIR. After approving a project for which an EIR has been prepared, the City shall file a Notice of Determination with the Los Angeles County Clerk. If the project requires discretionary approval from a state agency the notice shall also be filed with the Secretary of Resources. The Guidelines adopted by the Baldwin Park City Council implement the requirements of the California Environmental Quality Act CEQA) as amended. Purpose. The purpose of these Guidelines is to set forth procedures, principles, objectives, and criteria. These Guidelines are intended to be procedural, and are to be construed in conformity with CEQA and State Environmental Impact Report Guidelines. Early Preparation. Environmental documents should be prepared as early as feasible in the planning process to enable environmental considerations to influence project program and design. ARTICLE II. GENERAL RESPONSIBILITIES Adoption of Guidelines. These Guidelines have been officially adopted by the City Council of Baldwin Park. The City Council shall require changes to these Guidelines 1n response to future CEQA amendments and revisions to the State Environmental Guidelines. Consultation. The Lead Agency shall consult with all responsible agencies before completing a Draft EIR of Negative Declaration. Environmental Documents Combined with Existing Planning and Review Process.To the extent feasible, the environmental review process should be coordinated with the existing planning review and project approval process. The sponsoring city department should include the environmental documents as a part of the regular project report. SECTION 7.000 Fees and Charges. A. The City may charge and collect a reasonable fee to cover actual expenses from such person or entity in order to recover the estimated costs incurred in preparing and reviewing environmental documents. The fee for processing an Assessment for Environmental Impact is as determined by City Council resolution. B. The city department processing a project is granted authority to contract with consultants for the preparation of a Draft EIR at the request of the applicant. This fee will be in addition to all other applicable fees, and the consultant fee shall be determined by bid proposal submitted to the City and the applicant. C. The City may charge and collect a fee for the actual cost of reproducing a copy of an environmental document requested by a public agency or private individual. EXEMPT PROJECTS SECTION 8.000 Projects Exempt from Environmental Review and Notice of Exemption. A Notice of Exemption is a brief notice which may be filed when a public agency has determined that the project is exempt from CEQA requirements. This exemption occurs when the project is ministerial, categorically exempt, or an emergency project. A. Ministerial Projects. Activities for which the discretion of the public agency is limited and generally preclude the opportunity for denial or the setting of conditions for approval. A ministerial decision involves only the use of fixed standards or objective measurements without personal judgement. By action of the City Council, the following actions are, in most cases, deemed ministerial in nature: 1). Temporary occupancy permits. 2). Approval of minor variances. 3). PROJECT REVIEW AND EVALUATION SECTION 9.000 General Statement. This Article establishes the procedures for filing projects for environmental review, the procedures and criteria for performing project evaluation, and the decision making process for determining the significance of a project. Unless it can be seen with certainty that there is no possibility that the activity, either individually or cumulatively, may have a significant effect on the environment, environmental documents must be prepared and reviewed. SECTION 10.000 Procedures for Initiating Environmental Review. A. For each activity identified as a project" the applicant shall file an applicant's Environmental Information form with the City. B. Upon receipt of the Applicant's Environmental Information form, the City shall complete an Assessment for Environ- mental Impact. These forms together shall constitute an initial study, which, when completed shall establish information to make the following determinations: 1. The project is categorically exempt. 2. A Negative Declaration is required. 3. An Environmental Impact Report is required. ARTICLE V. NEGATIVE DECLARATION PROCEDURES SECTION 11.000 Negative Declaration Procedures. A Negative Declaration shall be prepared where it is found, on the basis of an initial study, that there 1s no possibility of a significant adverse effect on the environment. Before completing a Negative Declaration, the lead agency shall consult with all responsible agencies affected by the project. SECTION 12.000 Public Notice for Negative Declaration. Notice of the preparation of a Negative Declaration shall be.provided to the public within a reasonable period of time prior to final adoption by the public agency of the Negative Declaration. Notice shall be given to a11 organizations and Individuals who have previously requested such notice and shall also be given by at least one of the following procedures. A. Publication, no fewer times than required by Section 6061 of the Government Code, by the public agency in a newspaper of general circulation in the area affected by the proposed project. B. Posting of notice by the public agency on and off site in the area where the project is to be located. C. Direct mailing to owners of property contiguous to the project. D. The alternatives for providing notice specified herein shall not preclude a public agency from providing additional notice by other means if such agency so desires, nor shall the requirements of this section preclude a public agency from providing the public notice otherwise required by law for such a project. Notice of Determ-I nation for a Negative Declaration. SECTION 13.000 A. After an approval, or conditional approval by the City on a project for which a Negative Declaration was prepared, the City shall file a Notice of Determination with the Los Anqeles County Clerk. If the project required discretionary approval from a state agency, the Notice of Determination shall also be filed with the Secretary for Resources of the State. ARTICLE VI. ENVIRONMENTAL IMPACT REPORT PROCEDURES SECTION 14.000 General Statement. If after an initial study, it can be fairly argued on the basis of substantial evidence that there may be a significant adverse effect on the environment, or there is a serious public concern, the City must prepare, or cause to be prepared, an EIR. SECTION 15.000 SECTION 16.000 SECTION 17.000 EIR Public Notice. After completing a draft EIR, the Lead Agency shall consult with and obtain comments from public agencies having jurisdiction by law with respect to the project and should consult with persons having special expertise with respect to any environmental impact involved. The City shall provide the general public with an opportunity to comment on the EIR. A. The City shall provide public notice of the completion of a draft EIR at the same time as it sends a Notice of Completion to the Resources Agency. Notice shall be given to alt organizations and individuals who have previously requested such notice and shall also be given by at least one of the following procedures: 1)- Publication no fewer times than required by Section 6061 of the Government Code by the public agency in a newspaper of general circulation in the area affected by the proposed project. General Statement. Environmental Impact Reports shall contain the information outlined in CEQA and the State EIR Guidelines. Each element must be covered, and when these elements are not separated into distinct sections, the document shall state where in the document each element is discussed. Preparation of an EIR. The City shall require an applicant to submit data and information necessary to enable the City to prepare the EIR. This information shall be transmitted using the Information Data Sheet" provided. As an alternative the City may cause the preparation of EIR's utilizing consultants. A list of consultants that have indicated an ability to prepare EIR's wilt be developed by the City. From this list, the project applicant wilt designate three consulting firms he would tike to consider, or the applicant may submit the name of his own EIR contractor to be considered. In order to prevent any possible conflict of interest, and to preserve objectivity, the City will not consider utilizing any consulting firm that is associated with the project under consideration. ARTICLE VII. PROCEDURES FOLLOWING COMPLETION OF THE DRAFT EIR SECTION 18.000 Notice of Completion- As soon as the draft EIR 1s completed the public must be notified and a Notice of Completion must be filed with the State Clearinghouse. The notice shall include a brief description of the project, its proposed location, an address where copies of the EIR are available, and the period during which comments will be received, A form for the Notice of Completion is provided herein. SECTION 19.000 Adequate Time for Review and Comment. The period during which comments will be received on EIR's shall remain open until certification of the final EIR is made by the decision-making body; but in no case shall the review period be less than thirty 30) days. Where state review is required a minimum of forty five 45) days shall be observed unless a shorter period is approved by the State Clearinghouse. ARTICLE VIII. PREPARATION AND CERTIFICATION OF FINAL EIR SECTION 20.000 General Statement. The purpose of this Article is to define the procedures for completion of the final EIR by the City and the certification of the final EIR by the appropriate decision- making body. SECTION 21.000 Contents of the Final EIR, The final EIR shall consist of: A. The preliminary EIR; B. The minute record(s) of the recommending and/or decision- making body or; C. Comments and recommendations, received, either verbatim or in summary; D. A list of persons, organizations and public agencies commenting on the document; E. The responses to significant environmental points raised in the review and consultation process. SECTION 22.000 Findings. A. Specific economic, social, or other considerations make infeasible the mitigation measures or project alternatives identified in the final EIR. B. The findings required by subsection A) shall be supported by substantial evidence in the record. C. The finding in subsection A.2) shall not be made if the agency making the finding has concurrent jurisdiction with another agency to deal with identified feasible mitigating measures or alternatives. SECTION 23.000 Notice of Determination for an EIR. After approving a project for which an EIR has been prepared, the City shall file a Notice of Determination with the Los Angeles County Clerk. The California Environmental Quality Act has been changed considerably. The overall effect is: 1. To make preparation of Environmental Impact Reports easier, 2. To assure coordination of environmental review during the planning stages of a project. 3. To require more information in terms of initial study prior to determining whether a project will require an environmental impact report, a negative declaration, or is categorically exempt. These guidelines which include the assessment forms have been revised to conform to changes in CEQA. The City Attorney has reviewed these Environmental Guidelines. His recommended changes have been included. RECOMMENDATION The Planning Department recommends that the City Council adopt these guidelines by resolution.
