HomeMy WebLinkAbout1977 045 CC RESO1977 045 CC RESO;¢fìõpeRESOLUTION NO. 77-45 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK CERTIFYING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND ADOPTING SPECIFIC PLAN 31 TO ALLOW THE DEVELOPMENT OF A SINGLE FAMILY PLANNED UNIT DEVELOPMENT THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find and determine as follows: a. That on the 7th day of July, 1977, the City Council held a duly noticed public hearing to consider adoption of a Specific Plan as per Exhibit A" which is attached. b. That the property to which said Specific Plan 31 relates is described as: That certain 4.14 +/- acres, comprised of 5 lots located at the southerly intersection of Frazier Street and Fairgrove Avenue. Beginning at the most westerly corner of Lot 42, Tract 718 MB 17-17 as recorded in Los Angeles County Recorder's Office. Thence south 50° 53' 30" east 423.68 feet, thence north 39° 06' 30" east 425 feet, thence north 50° 53' 30" west 408.68 feet and thence along a curve at the southerly intersection of Frazier Street and Fairgrove Avenue, R=15, L=23.36 feet, thence south 39° 08' 30" west 321 feet, thence north 50° 53' 30" west 10 feet to ti'e true point of beginning. All within the City of Baldwin Park, County of Los Angeles, c. That as a result of testimony and facts presented at said hearing the City Council finds that the proposal for a single family planned unit develop- ment is an implementation of the General Plan and is conducive to surrounding uses of the land. SECTION 2. That the City Council does hereby certify the Negative Declaration of Environmental Impact and adopt Specific Plan SP-31, as shown on the attached Exhibit A" subject to the following conditions: a. That the subject property be developed with single family homes substantially as shown on Exhibit A". b. That the landscaping plan for all street side properties be developed and be subject to Precise Plan Review. c. That except for the Frazier Street side yard and all front yards, additions may be made by subse- quent owners into the rear and side yards provided that the following setbacks be maintained: 1) rear 15 foot setback, 2) side 5 foot setback, and 3) accessory structures are as permitted by Code. Variances to these dimensions shall be by modifi- cation to Specific Plan 31, d. That the applicant prepare a map to subdivide the land into 24 single family lots pursuant to city regulations. e. That the applicant sign an affidavit within fifteen 15) days after the adoption of the resolution that he has read and accepts a11 the conditions of approval. That the applicant shall comply with all conditions of approval as stated by the resolution within a time limit of not to exceed one 1) year, unless otherwise noted herein, or the approval given shall be null and void. g. That all rear yard setbacks shall be 15 feet minimum. SECTION 3. That the City Clerk shall certify the adoption of this resolution. APPROVED AND ADOPTED this 7th day of July, 1977.
