HomeMy WebLinkAbout1977 057 CC RESO1977 057 CC RESO;¢fìõÆpe RESOLUTION NO. 77-57 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING AN APPLICATION FOR A CONDITIONAL USE PERMIT TO ESTABLISH A CHURCH ON R-1 PROPERTY AT 13212 FRANCISQUITO AVENUE AND CERTIFYING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT CASE NO. CP-243; APPLICANT: LUIS MARTINEZ, REPRESENTING BREAKTHROUGH INTER- DENOMINATIONAL CHURCH) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That a duly noticed public hearing was held by the Planning Commission on April 27, 1977 and continued to June 22, 1977, on the application of Breakthrough Interdenominational Church for a conditional use permit to establish a church on R-1 property at 13212 Francisquito Avenue, in the City of Baldwin Park, California, more particularly described as: The northeasterly 294.34 feet of the northwesterly 102.22 feet of the southeasterly 204.44 of Lot 52, Tract No. 8805, as per map recorded in Book 116, Pages 1 and 2 of Maps in the Office of the County Recorder of Los Angeles County. b) That the Planning Commission's denial of said permit was appealed to the City Council. SECTION 2. That the City Council conducted a duty noticed public hearing on the appeal and does hereby certify the Negative Declaration of Environmental Impact and approve the conditional use permit, subject to the following con- ditions: 1. That a six 6) foot high masonry wall shall be constructed around the subject property. Where the wall is within the twenty 20) foot front yard setback it shall be 36 inches high above finished grade. There shall be landscaping in lieu of a wall in the front. 2. That the parking area shall be paved, and striped with 10 x 20 foot stalls. Each stall shall have an individual concrete wheel stop. 3. That the existing garage and shed shall be removed. The house shall be remodeled to meet alt requirements of the Baldwin Park Building Division for a church building. 4. That a twenty 20) foot front yard setback shall be maintained for any new buildings or parking. The front yard setback shall be permanently landscaped and irrigated. 5. That plans for Items 1 through 4 shall be submitted to the Planning Department for Precise Plan Review. No occupancy permits shall be issued prior to completion of the enumerated items. Precise Plan Review shall include at least, location and type of landscaping and irrigation, location and type of exterior lighting, drainage/grading plan and signs. 6. That the church structure be limited to 137 people pursuant to the building code. That the property be developed substantially in accordance with the amended plot plan on file in Case No. CP-243. 8. That the conditions herein shall be fu11y applicable to any successors in interest, heirs and assigns of the applicant and/or property owner. 9. That the applicant shall sign a notarized affidavit within fifteen 15) days after the adoption of the resolution that he has read and accepts all the conditions of approval. 10. That the applicant and/or property owner shall comply with alt the conditions of approval as stated by the resolution within a time limit of not to exceed six 6) months, unless otherwise noted herein, or the approval given for the variance may be subject to revocation pursuant to Section 9483 of the Baldwin Park Zoning Code. SECTION 3. The City Clerk shall certify to the adoption of this Resolution and forward a copy thereof to the applicant and to the Secretary of the Planning Commission.
