A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF BALDWIN PARK,
CALIFORNIA, RECITING THE FACT OF
THE SPECIAL MUNICIPAL ELECTION
HELD IN SAID CITY OF BALDWIN PARK
ON THE 22ND DAY OF NOVEMBER, 1977,
DECLARING THE RESULT THEREOF AND
SUCH OTHER MATTERS AS ARE PROVIDED
BY LAW
WHEREAS, a special municipal election was held and conducted in the
City of Baldwin Park, County of Los Angeles, State of California, on Tuesday,
the 22nd day of November, 1977 as required by law; and
WHEREAS, a notice of said election was duly and regularly given in
time, form and manner as provided by law; that voting precincts were property
established; that election officers were appointed and that in all respects
said election was held and conducted and the votes cast thereat, received and
canvassed and the returns made and declared in time, form and manner as
required by the provisions of the Elections Code of the State of California
for the holding of elections in cities; and
WHEREAS, pursuant to Resolution No. 77-91 adopted the 3rd day of
November, 1977, the City Clerk of the City of Baldwin Park canvassed the
returns of said election and has certified the results to this City Council,
said results are received, attached and made a part hereof as Exhibit A11.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. That there were 16 voting precincts established for the
purpose of holding said election consisting of consolidations) of the regular
election precincts in the City of Baldwin Park as established for the holding
of state and county elections.
SECTION 2. That said special municipal election was held for the
purpose of submitting to the qualified voters of said city the question of the
recall of certain officers and the method of electing their successors if the
recall prevailed, to wit:
Shall Jerry R. Kitchet be recalled removed) from the
office of Member of City Council?
Shall Emmit R. Waldo be recalled removed) from the
office of Member of City Council?
If the recall prevails shall the City Council fill the
vacancy or vacancies by appointment or call a special
election for that purpose?
BY APPOINTMENT
BY SPECIAL ELECTION
SECTION 3. That the whole number of votes cast in said City except
absent voter ballots) was 3,775.
That the whole number of absent voter ballots cast in said City was
76, making a total of 3,851 votes cast in said City.
SECTION 4. As a result of said election a majority of the qualified
voters voting on said measures relating to the recall of Jerry R. Kitchel and
Emmit R. Waldo did vote in favor thereof and that Jerry R. Kitchet and Emmit R
Waldo were recalled from the office of Member of the City Council.
If the recall prevails the majority of the voters voted for titling
the vacancies by special election.

That the number of votes given at each precinct and the number of
votes given in the City to each measure are as listed in Exhibit A" attached.
SECTION 5. The City Clerk shall enter on the records of the City
Council of said City, a statement of the result of said election showing:
1) The whole number of votes cast in the City;
2) The measures voted upon;
3) The number of votes given at each precinct for and against the
recall and for and against filling the vacancy or vacancies by
special election or appointment;
4) The number of votes given in the City for and against the recall
and for filling the vacancy or vacancies by special election
or appointment.
SECTION 6. That the City Clerk shall certify to the passage and
adoption of this resolution; shall enter the same in the book of original
Resolutions of said City; and shall make a minute of the passage and adoption
thereof in the records of the proceedings of the City Council of said City, in
the minutes of the meeting at which the same is passed and adopted.
PASSED. APPROVED. AND ADOPTED this 29th day of November. 1977.
