HomeMy WebLinkAbout1977 103 CC RESO1977 103 CC RESO(ÌìópeRESOLUTION NO. 77-103 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A ZONE VARIANCE TO CREATE LOTS WITH LESS THAN 60 FEET OF FRONTAGE AND CERTIFICATION OF THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT CASE NO. ZV-349; APPLICANT: HAROLD SHARP) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find and determine as follows: a. That on the 15th day of December, 1977, the City Council held a duty noticed public hearing on an appeal to the decision of the Planning Commission for a variance to create lots with less than 60 feet of frontage; and b. That the property on which said variance application relates is located at 15101 Badilto Street, in the City of Baldwin Park, County of Los Angeles, State of California more particularly described as: A11 of that land lying westerly of Tract 29239, Map Book 756-98-100 in the Los Angeles County Recorder's Office and southeasterly of the Big Dalton Wash and northerly of Badillo Street. c. That the applicant's proposed lot frontages are similar to a majority of similarly developed property in the immediate vicinity. d. That the location of the existing streets and the shape of the property is such that the extreme depth and lack of width make conventional lots an impossibility. e. The proposed development would be an implementation of the General Plan. f. That the facts presented in the staff report are accurate and true. SECTION 2. That the variance, as described above, is hereby approved and certification of the negative declaration of environmental impact subject to the following conditions: a. That all conditions of Parcel Map No. 946 be completed and recorded as required by law. b. That vehicular access to the garage on Lot 19 as shown on Parcel Map No. 946 be restricted to be from Adams Drive. c. If access to Lot 19 from Adams Drive cannot be obtained, the triangular shaped land area. Lots No. 15, 16, 17, 18 and 19 north of Kenoak Drive, shall be resubdivided into not more than four lots. d. That there shall be provisions on Lots 1 through 8 for vehicles to adequately turn around so that cars are able to enter Badillo Street in a forward manner. e. That a11 applicable permits be obtained and approved before occupancy of the properties. That the variance shall be in force for the duration of Parcel Map No. 946. If the conditions of approval as stated by the resolution are not complied with, the approval given for the variance may be subject to revocation pursuant to Section 9483 of the Baldwin Park Zoning Code. g. That the applicant sign a notarized affidavit within fifteen 15) days after the adoption of the resolution that he has read, understands, and accepts the conditions of approval. SECTION 3.
