HomeMy WebLinkAbout1978 006 CC RESO1978 006 CC RESO(Ììó8peRESOLUTION NO. 78-6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK CERTIFYING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND ADOPTING SPECIFIC PLAN 34 TO ALLOW THE DEVELOPMENT OF A SINGLE FAMILY PLANNED UNIT DEVELOPMENT THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find and determine as follows: a. That on the 5th day of January, 1978, the City Council held a duly noticed public hearing to consider adoption of a Specific Plan request for a residential planned unit development at 3343 through 3427 Puente Avenue, in the City of Baldwin Park, County of Los Angeles, State of California, more particularly described as: Lots 25 through 30 of L.S. 21-41 as recorded in the Los Angeles County Recorder's Office. b. That the Environmental Quality Control Act of 1970 as amended, has been complied with insofar as the above application is concerned. The City Council has reviewed the matters relating to the Negative Declaration as filed and has determined that the Negative Declaration was appropriate and such procedure and declaration are hereby approved, c. That as a result of testimony and facts presented at said hearing the City Council finds that the proposal for a residential planned unit development is an implementation of the General Plan and is conducive to surrounding uses of the land. SECTION 2. That the City Council does hereby certify the Negative Declaration of Environmental Impact and adopt Specific Plan SP-34, as shown on the attached Exhibit A" subject to the following conditions: a. That the subject property be developed with single family homes substantially as shown on Exhibit A". 1. Lots 1 through 18 shall be built as conventional single family homes consistent with R-1 setback regulations, exceptions for lots of less than 6,000 square feet in area are included. 2. Lots 19 through 42 shall be built substantially as shown on Exhibit A" including reduced lot areas and modified setbacks. b. That permanent access and maintenance for rights-of-way for lots 19 through 42 shall be protected permanently by a recorded document. The document shall be approved by the City Attorney as to content. c. That yards for Lots 19 through 42 shall be: rear, at the garage end of the buildings, front, at the opposite end; and the remaining are side yards- d. Building construction envelopes for Lots 19 through 42 shall be limited to the areas shown as buildings on Exhibit A", including location of fences and waits. e. That variances to the setbacks and yard areas of Specific Plan 34 as adopted shall be by modification of the plan. That two sets of detailed plans be submitted for precise plan review, plan check and engineering review. Plans shall include, but are not limited to the following: 1. Site Plan; 2. Grading Plan for the entire development; 3. The location, proposed use, size, height, floor plans, front and side elevations, type of materials to be used for the exterior walls of all proposed and existing buildings on the subject lot or lots; and 4. The location, height and type of materials to be used in the construction of all walls and fences; and 5. The location and dimensions of pedestrian and vehicular streets and access ways; and 6. The location of any outdoor lighting fixtures; and 7. A detailed plan for the landscaping of the development, including the location and height of screen planting, and a statement setting forth the method by which such landscaping and fencing shall be maintained after installation; and 8. Six 6) foot high solid concrete block walls shall be constructed along the perimeter property lines, interior lots shall have cross fencing, and concrete block pillars with wrought iron between shall be constructed along the Puente frontage, vandal-proof paint shall be used on alt fences and walls that are within fifty 50) feet of Puente Avenue; and 9. Th.e location or proposed location, of all physical features, including but not limited to, such items as fire fighting facilities, utility facilities, drainage and sewage structures. g. That the applicant prepare a map to subdivide the land into 42 single family lots. h. That the applicant sign an affidavit within fifteen 15) days after the adoption of the resolution that he has read and accepts all the conditions of approval. i. That the applicant shall comply with all conditions of approval as stated by the resolution within a time limit of not to exceed one 1) year, unless otherwise noted herein, or the approval given shall be null and void. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution.
