A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK PROTESTING THE
PROPOSED CHANGE IN METHOD OF DISTRIBUTION
OF FINES AND FORFEITURES BY LOS ANGELES
COUNTY
WHEREAS, for many years a fair and equitable method of distributing
fines and forfeitures has been in effect; and
WHEREAS, now the County Auditor of Los Angeles proposes to interpret
existing legislation in a manner that would result in a reduction in the cities
revenue from court fines and forfeitures and allocation of a larger share of
these revenues to the county; and
WHEREAS, cities do not agree with the opinion of the county and
would lose substantial revenue based on wh^t appears to be a proposed grossly
unfair distribution of revenues.
NOW, THEREFORE, be it resolved that the City Council of the City of
Baldwin Park declares as follows:
1. It does not aqree with thp County Auditor's opinion cind
opposes th^ proposed I'^u.i/' \s'- i, Unbutton of fines
and forfeitures wniOi wouM reduce city revenues and
increase the county shai^.
2. The City of Baldwin Park urges thr League of California
Cities and all cities to v in tt.^h protest to their
county officials and PX(ri strong uolitical efforts and
take legal action to prpv^-nt fhe county takeover of
city revenues.
3. That the elected representatives to thp State Legislature
review existing provisions of Penal Code Section 1463
and Vehicle Code Section 4050H regarding distribution
of fines and forfeitures and take action if necessary
to clarify and insure cities continue to receive their
fair share of fines and forfeitures as in the p<ist.
4. The City Clerk is directed to forward copies of this
resolution to all cities in os Anqeles County, the
Ledque of Cd i i form'i Ciiics, the Governor dnd K'^tf^t
representatives to the State Legislature from the
immediate area.
