HomeMy WebLinkAbout1978 024 CC RESO1978 024 CC RESO(ÌìójpeRESOLUTION NO. 78-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK REVOKING A CONDITIONAL USE PERMIT TO OPERATE A TRAILER PARK LOCATION: 12793 EAST GARVEY AVENUE; CASE NO.: CP-131) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That pursuant to the applicable provisions of the Baldwin Park Municipal Code, the Planning Commission conducted a series of hearings to consider whether the conditional use permit heretofore issued in Case No. CP-131, should be revoked on the grounds that the said use is being operated so as to constitute a nuisance and/or that the owner/operator has failed to comply with the specific conditions of approval set forth in Commission Resolution No, 69-48; and b) That the Commission revoked said permit, which decision was the subject of a timely appeal, appealing the same to the City Council; and c) That the City Council conducted duly noticed public hearings on said matter and, as a result of the evidence presented at said hearings, determined as follows: 1) that the property referred to in the conditional use permit is located at 12793 East Garvey Avenue, and is more particularly described in Commission Resolution No. 69-48; and 2) that the use permitted by said condi- tional use permit, being No, CP-131, as it is, and has been, conducted, is a public nuisance and is a menace to the public health and safety; in this respect the findings set forth in the staff report, dated March 9, 1978, are hereby adopted as the findings of the City Council with respect to the issue of public nuisance; and BIB] 37684-U01 1978-U02 024-U02 CC-U02 RESO-U02 LI3-U03 FO10488-U03 FO10731-U03 DO10922-U03 C6-U03 RESO-U03 3/3/2003-U04 ROBIN-U04 1978 024 CC RESO(ÌìójpeResolution No. 78-24 Page 2 3) that the owner/operator as to the use permitted by said CP-131, has failed to comply with express conditions of approval, as set forth in said Commission Resolution No. 69-48, as is specifically enumerated in the said March 9, 1978, staff report, which are hereby adopted as the findings of this City Council; and 4) that it appearing that the said use is, and has been, conducted so as to constitute a public nuisance and that the owner/operator has failed to comply with the specified conditions of approval as above described, that the public interest, convenience, and necessity require that the said conditional use permit be revoked forthwith. SECTION 2. That the above described conditional use permit heretofore issued in Case No. CP-131 be, and the same hereby is, revoked. Revocation shall be deemed, for all purposes, to be effective as of the date of adoption of this Resolution. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution and shall forward a certified copy hereof to the applicant and to the Secretary of the Planning Commission.
