HomeMy WebLinkAbout1978 069 CC RESO1978 069 CC RESO(ÌìôRESOLUTION NO. 78-69 A RESOLUTION OF THE BALDWIN PARK CITY COUNCIL APPROVING A CONDITIONAL USE PERMIT TO OPERATE A SELF-SERVICE GAS STATION AND CERTIFYING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AT 13402 RAMONA BOULEVARD CASE NO. CP-267; APPLICANT: PAUL LOCKHARD FOR NATIONAL CON- VENIENCE STORES) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find and determine: a) That the Planning Commission held a duly noticed public hearing on an application for a conditional use permit to operate a self-serve service station in a C-2 zone; and b) That the property to which said conditional use permit relates is located at 13402 Ramona Boulevard in the City of Baldwin Park, County of Los Angeles, State of California, more particularly described as: The Swiy 150 ft of the Nwty 140 ft of Lot 22, Tract No. 718, as per map recorded in Book 17 Page 17 of Maps with the Los Angeles County Recorder c) That the Planning Commission denied such application and thereafter a timely appeal was filed, appealing the Planning Commission's decision to the City Council. SECTION 2. That the City Council conducted a duty noticed public hearing on the appeal and does hereby certify the Negative Declaration of Environmental Impact and approve the conditional use permit, subject to the following conditions: 1. That the property be developed substanialty as shown on the applicant's proposed site plan, except as modified hereby. 2. That alt outdoor lighting shall be shielded and maintained so as to prevent any glare, reflection, nuisance or inconvenience of any kind to abutting or adjacent properties. 3. That at 1 signs shall be approved by the Planning Department prior to the construction or erection of any sign on property. 4. That a landscape and irrigation plan, which shall include an 8 foot high concrete block wall and landscaping in a planter 3 feet wide both running along the South property tine, shall be prepared by the applicant and submitted to the Planning Department for a Precise Plan Review prior to the issuance of any building permits. 5. That the property, its improvements, landscaping, paving and the tike shall be permanently maintained in a neat and orderly fashion. 6. That the conditions herein shall be fully applicable to any successors in interest, heirs and assigns of the applicant and/or property. 7. The applicant shall sign an affidavit within fifteen 15) days after the adoption of the resolution that he has read and accepts a11 the conditions of approval. The applicant and/or property owner shall comply with ail the conditions of approval as stated by the resolution within a time limit not to exceed six 6) months or revocation proceedings pursuant to Section 9483 of the Baldwin Park Zoning will be commenced. SECTION 3. The City Clerk shall certify to the adoption of this Resolution and forward a copy thereof to the applicant and to the Secretary of the Planning Commission.
