HomeMy WebLinkAbout1978 098 CC RESO1978 098 CC RESO(ÌìôZRESOLUTION NO. 78-98 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A ZONE VARIANCE TO SECTION 9552.3A OF THE ZONING CODE TO PERMIT A ROOM ADDITION IN THE FRONT YARD SETBACK ON PROPERTY LOCATED AT 15102 SWANEE LANE APPLICANT: WILLIAM GHENT CASE NO. ZV-359) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Baldwin Park does hereby find and determine as follows: a. That the Planning Commission held a duty noticed public hearing on the application for a zone variance to Section 9552.3a of the zoning code to permit a room addition in the front yard setback; b. That the property to which said zone variance application relates is located at 15102 Swanee Lane in the City of Baldwin Park, County of Los Angeles, State of California more particularly described as: Lot 33 of Tract 16302 as recorded in MB 376-11 of the Los Angeles County Recorder's Office. c. That the Planning Commission determined that the zone variance should be granted in that: i) There were exceptional circumstances applicable to the subject property which do not generally apply to other property in the same zone in that the subject property's location on the corner requires a 10 foot side yard whereby the buitdabte area is reduced. 1i) The variance is necessary for the presentation and enjoyment of a substantial property right possessed by other properties similarly situated but which is denied to the property in question in that homes fronting along Swanee Lane are of a squarish", boxy" design white the subject property's single family home is linear. The addition in the front would square-off the subject property's house along Swanee Lane. iii) The granting of the variance wilt not be materially detrimental to the public welfare or injurious to the adjacent properties since the subject request is in keeping with the residential character of the neighborhood. From the curb to the face of the structure there exists 32 feet. If the request is approved there would remain 26 feet of landscaped front yard. iv) The granting of the variance w111 not be materially detrimental to the public welfare or injurious to adjacent properties. d. That the decision of the Planning Commission was timely appealed to the City Council and thereafter, the City Council conducted a duty noticed public hearing upon said appeal, and thereafter, determined to adopt the Commission's findings, and its decision. That the City Council hereby approves the above zone variance and certification of the negative declaration of environmental impact subject to the following conditions: a. That the property be developed substantially as shown on the plans submitted with this case. b. Public improvements shall be installed as required by the the Engineering Division as follows: 1. Construction of sidewalk in and along the property's street frontage. 2. Plant two 2) street trees. c. That the conditions herein shall be fully applicable to any successors in interest, heirs and assigns of the applicant and/or property owner; d. That the applicant shall sign a notarized affidavit within fifteen 15) days after the adoption of the resolution that he has read and accepts all the conditions of approval; e. That the applicant and/or property owner shall comply with a11 the conditions of approval as stated by the resolution within a time limit of not to exceed six 6) months, unless otherwise noted herein, or the approval given for the variance may be subject to revocation pursuant to Section 9483 of the Baldwin Park Zoning Code. SECTION 3. That the City Clerk shall certify to the adoption of this resolution and forward a copy hereof to the applicant and the Secretary of the Planning Commission.
