CASE NO. ZV-356; APPLICANT: DWAINE GLASS FOR JACK P. STRUBLE) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the C-ity Council of the City of Baldwin Park does hereby find and determine: a) That on the 28th day of June, 1978, the Planning Commission held a duty noticed public hearing on a zone variance to create two lots of-less than 60 feet in R-1 zone; and b) That the property on which said variance is located is at 4713 Edra Avenue, in the City of Baldwin Park, County of Los Angeles, State of California, more particularly described as: Lot 24 of Tract 13588 as per map recorded in Book 273, Pages 29 and 30 of maps in the office of the County Recorder for Los Angeles County c) That the Planning Commission denied such application and thereafter a timely appeal was filed, appealing the Planning Commission's decision to the City Council SECTION 2. That the City Council conducted a duty noticed public hearing on the appeal and makes the following findings: 1. The subject property is the same size width and depth) as three other properties on the street. The property is physically different from the other neighboring lots. There are exceptional or extraordinary circumstances or conditions applicable to the property in that it is the only lot with two residences that has the lot area for two 6,000 sq. ft. lots in the neighborhood. 2. As with the subject property, various properties including one contiguous to the south, are developed with two single family residences, a right possessed from prior ordinances. Many lots on the block have 50 or less feet of frontage. 3. Approval of this variance would create a precedent wherein three other lots of similar size in the neighborhood could be divided. The effect would be limited to three, assuming building placement is appropriate. 4. Division of larger lots into smaller 6,000 sq. ft. single family lots would not adversely effect the General Plan. The maintenance of two single family homes on one lot wi11 not affect the plan either, since the density of dwelling units is not increased. SECTION 3. That the City Council does hereby approve the zone variance, subject to the following conditions: 1. That a parcel map be initiated and recorded to divide the subject property substantially as shown on the plot plan. Exhibit A. 2. That the guest house be demolished or be reconstructed to meet existing zoning regulations and the lot cleared of debris prior to recordation of the map. 3. That the main dwellings shall be provided with two car garages. 4. That paved access be provided per code to a11 parking structures. 5. That the applicant shall sign a notarized affidavit within fifteen 15) days after the adoption of the resolution that he has read and accepts a11 the conditions of approval. 7. That the applicant and/or property owner shall comply with a11 the conditions of approval as stated by the resolution within a time limit of not to exceed six 6) months, or the time schedule to be consistent with the duration of the Parcel Map. If the conditions of approval as stated by the resolution are not complied with, the approval given for the variance may be subject to revocation pursuant to Section 9483 of the Baldwin F^ark Zoning Code. SECTION 4. That the City Clerk shall certify to the adoption of this Resolution and forward a copy thereof to the applicant and to the Secretary of the Planning Commission.
