A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK REVOKING A MINOR
VARIANCE LOCATION: 4610 WALNUT STREET;
APPLICANT: ALFRED SANDOVAL. CASE MV-16)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin
Park does hereby find and determine as follows:
a) That the City Planner held a hearing to
consider the revocation of a minor zone variance. No. MV-16;
and
b) That the property to which said minor variance
relates is located at 4610 Walnut Street, in the City of
Baldwin Park, County of Los Angeles, State of California,
more particularly described in the Planning Division's case
file; and
c) That the City Planner determined after a
hearing that the mi nor zone variance should be revoked; and
d) That a timely appeal was taken, appealing the
decision of the City Planner to the City Council; and
e) That after conduct ing a hear ing de novo, upon
said matter, and each member of the Council being familiar
with the site, the Council determined that the facts show:
1) A failure to comply with conditions of approval; and
2) That the use, as conducted, constitutes a nuisance
to adjacent properties; and
3) That the continuance of the use directly interferes
with the peaceful use and enjoyment of adjacent properties;
and
SECTION 2. That the minor zone variance, above described,
to wit: MV-16. be and hereby is revoked, effective forthwith.
SECTION 3. That the City Clerk shall certify to the
adoption hereof, and forward a certified copy of this Resolution
to the appli-cant and to the City Planning Division.
