A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK DENYING A ZONE VARIANCE
LOCATION: 13716 MONTEREY AVENUE: APPLICANT:
MENDLESON & HOLTGRIEVE. CASE MV-84)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin Park does
hereby find and determine as follows:
a) That the City Planner held a hearing to consider
a minor zone variance. No. MV-84;
b) That the property to which said minor variance
relates is located at 13716 Monterey Avenue, in the City of Baldwin Park,
County of Los Angeles, State of California, more particularly described
in the Planning Division's case file; and
c) That the Planning Division determined after a hearing
that the minor zone variance should be approved; and
d) That a timely appeal was taken, appealing the decision
of the Planning Division to the City Council; and
e) That after conducting a hearing de novo, upon said
matter, and each member of the Council being familiar with the site, the
Council determined that the facts show:
1) That there are no exceptional or extraordinary circumstances or
conditions applicable to the property involved or to the intended
use of such property, which do not generally apply to other
property in the same zone; and
2) That such variance is not necessary for the preservation and
enjoyment of a substantial property right possessed by other
property similarly situated, but which is denied to the property
in question; and
3) That the granting of the variance will be materially detr-imental
to the public welfare or injurious to the adjacent property; and
4) That the granting of the variance wilt adversely affect the General
Plan of the City of Baldwin Park.
SECTION 2. That the zone variance, above described, be and hereby is
denied.
ACTION 3. That the City Clerk shall certify to the adoption hereof,
K? forward a certified copy of this Resolution to the applicant and to the
