HomeMy WebLinkAbout1979 090 CC RESO1979 090 CC RESO(ÌìòtRESOLUTION NO. 79-90 A RESOLUTION OF INTENTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ESTABLISH A PARKING AND BUSINESS IMPROVEMENT AREA IN THE CITY OF BALDWIN PARK THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park hereby finds, determines, and declares as follows: a) That pursuant to Part 6, Division 18, Section 36500 et. seq. of the Streets and Highway Code of the State of California, the City Council hereby declares its intentions to create a Parking and Business Improvement Area and; b) A description of the area boundaries are per Exhibit A" and a map defining the boundary is per Exhibit B" c) A Public hearing shall be held on October 3, 1979, at 7:30 p.nr in the City Council Chambers of the City of Baldwin Park; and The proposed use of the revenue will be for: d) 1) the acquisition, construction, or maintenance of parking 2) decoration of any public place in the area 3) promotion of public events which are to take place on or in public places in the area 4) furnishing of music in any public place in the area 5) the general promotion of business activities in the area e) The description of the system of assessment or charge is per Exhibit C" f) Multiple Businesses: Businesses which are combinations of two or more of the above classes. The highest fee of any one business taken individually>shall be the additional assessment. g) Payment of Tax: The additional tax hereby levied shall be due and payable and shall be paid at the same time and in the same man- ner that the business license tax imposed by City Code is due and payable in accordance with the terms of this Chapter. h) Payment Prerequisite to License: No business license shall be issued pursuant to this Article unless the additional business license tax imposed by this Chapter is paid together with the business license payable pursuant to an imposed by City Code. i) Refusal to Pay Tax: No person shall fail or refuse to pay the additional business license tax imposed by this Chapter. j) Voluntary Contribution: Any business which is exempt from the payment of the tax by reason of the provisions of the Constitu- tion of the United States or the State of California, or whose place of business is outside of Business Improvement Area, may make a voluntary contribution to said business improvement area for the purposes provided in this Chapter, BIB] 37683-U01 1979-U02 090-U02 CC-U02 RESO-U02 LI3-U03 FO10488-U03 FO10489-U03 DO10842-U03 C6-U03 RESO-U03 3/3/2003-U04 ROBIN-U04 1979 090 CC RESO(ÌìòtResolution No. 79-90 Page 2 SECTION 2.
