RESOLUTION NO. 80-68
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BALDWIN PARK, ORDERING A REPORT UNDER THE SPECIAL
ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY
PROTEST ACT OF 1931, RELATING TO RIVERGRADE
COMMERCENTER ASSESSMENT DISTRICT
WHEREAS, on August 6, 1980, the City Council of the City
of Baldwin Park ordered the formation of an Assessment District and
adopted a Resolution declaring its intention to proceed with a
special assessment proceeding under the Improvement Act of 1911
Division 7 of the States and Highways Code).
NOW/ THEREFORE, the City Council of the City of Baldwin Park,
DOES HEREBY RESOLVE, DETERMINE AND ORDER, as follows:
SECTION 1. That said proposed district shall be designated
and referred to in the proceedings for the formation thereof as
Rivergrade Commercenter Assessment District."
SECTION 2. That the exterior boundaries of said proposed
district in said City to be specially assessed to pay all or any
part of the cost of the proposed acquisition and improvement are
generally shown on a map on file in the Office of the City Clerk of
the City of Baldwin Park and designated, Map Showing Boundaries of
District Proposed to be Assessed for Improvements to be Made in
Rivergrade Commercenter Assessment District."
SECTION 3. That the nature, location and extent of the
proposed acquisition is as set forth in Resolution 80-67 to which
reference is hereby made.
SECTION 4. That the proposed improvement shall be
constructed on the lands to be acquired as described in Section 3,
Live Oak Avenue and Rivergrade Road in the City of Baldwin Park.
SECTION 5. That the nature, location and extent of the
proposed improvement are as follows:
1. Curbs 8. Landscaping
2. Gutters 9. Drainage Facilities
3. Sidewalks 10. Water Lines
11. Gas Lines
4. Drive Approaches
5. Street Pavement
6. Street Lights
7. Sewers
12. Electrical Distribution
Facilities
13. Telephone Facilities
14. Any and all work and
materials appurtenant
thereto.
SECTION 6. That the law under which the proceedings are
to be conducted is the said Improvement Act of 1911.
SECTION 7. That serial bonds, bearing interest not to
exceed the maximum provided by law, shall be issued to represent each
assessment of Fifty Dollars $50.00) or more, remaining unpaid for
thirty 30) days after the due date as set forth in Section 5390 of
the Streets and Highways Code. Said serial bonds shall extend over
a period ending fifteen 15) years from the second day of January next
succeeding the next September first following their date. Said bonds
shall contain a five percent 5%) redemption penalty provision as
provided by Section 6464 of the Streets and Highways Code. Payments
on the principal of unpaid assessments and interest thereon shall be

made by property owners to the City Treasurer, and the same shall
be disbursed by said City Treasurer, all as provided in the
Improvement Act of 1911", herein referred to.
SECTION 8. That the Engineer of Work is hereby directed
to procure the required information and prepare and present to this
City Council the report required by the Special Assessment
Investigation, Limitation and Majority Protest Act of 1931 as set
forth in Division 4 of the Streets and Highways Code.
SECTION 9. The City Clerk shall certify to the adoption
of this Resolution.
