HomeMy WebLinkAbout1981 007 CC RESO1981 007 CC RESO(Ììï-RESOLUTION NO. 81-7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA/ AUTHORIZING THE DESTRUCTION OF CERTAIN RECORDS IN THE RECORDS SECTION OF THE POLICE DEPARTMENT WHEREAS, there is presented to this Council the following letter: Honorable Mayor and City Council City of Baldwin Park California Gentlemen: In accordance with the provision of Section 34090 of the Government Code of the State of California, I intend to destroy the following records: Daily logs over two years old Court transmittals over two years old Vehicle repossession reports over two years old Warrant recall sheets over two years old Crime report number sheets over two years old Bail receipts over two years old Parking citations over two years old Deceased arrest files with no foul play) over two years old Expired bicycle licenses over three years old Stored and released vehicle reports over three years old Information only insurance reports over three years old Field Interogation cards over three years old Impounded vehicle reports over five years old Non-injury traffic accident reports over five years old Injury/Overdose/Attempt suicide reports not resulting in death) over five years old Lost and Found reports over five years old Missing persons reports which have been cleared over five years old Miscellaneous complaint reports over five years old Courtesy reports for other agencies over five years old Moving violation citations over five years old Misdemeanor crime reports providing that? There is no outstanding warrant related to the report There is no property outstanding in DOJ and/or N.C.I.C. There is no death connected with the report The report is not involved in civil or criminal litigation The report does not involve a Baldwin Park City employee over five years old Injury traffic accident reports over seven years old Felony crime reports providing that? There is no death connected with the report The report is not classified under Section 800 P.C., 290 P.C. and/or 11850 H&S over seven years old Photographs relating to destroyed records Fingerprint cards relating to destroyed records The foregoing records do not include any documents relating to citizen complaints or investigations in response to citizen complaints relating to members of the Police Depart- ment, to internal affairs investigation files, to capitol crimes, embezzlement of public funds, bribery of public officials, reports involving Baldwin Park City employees nor any child abuse reports. The foregoing records are no longer required for the operation of the Police Department, are not required to be kept by statute and are not less than two years old. Respectfully submitted, DAVID L. SNOWDEN Chief of Police In accordance with the provisions of Section 34090 of the Government Code of the State of California, the City Attorney hereby gives his written consent to the destruction of the foregoing records. ROBERT J. FLAHDRICK City Attorney WHEREAS, the City Council finds that the records hereinabove referred to are of no further value to the City of Baldwin Park, and that they occupy badly needed storage space; and WHEREAS, the City Attorney has, in accordance with the provisions of Section 34090 of the Government Code of the State of California, consented to the destruction of said records and documents; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1. That the Chief of Police is hereby authorized and granted authority to dispose of the hereinabove described and set forth records by causing the same to be destroyed in a lawful manner. Upon destruction of the foregoing records, the Chief of Police shall make a certificate of complete destruction of said records and file the original of the same in the office of the City Clerk and file a copy of said certificate together with a certified copy of this resolution in his/her office. SECTION 3. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter, the same shall be in full force and effect.
