HomeMy WebLinkAbout1981 043 CC RESO1981 043 CC RESO(ÌìîÃRESOLUTION NO. 81- 43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK IN SUPPORT OF SENATE CONSTITUTIONAL AMENDMENT 7, RELATING TO EVIDENCE IN CRIMINAL MATTERS WHEREAS, the California Supreme Court has extended the exclusionary rule" relating to evidence beyond the requirements of the United States Constitution; and WHEREAS, the court has established through judicial fiat a procedural rule which severely hampers California law enforcement efforts; and WHEREAS, Senate Constitutional Amendment 7 will prohibit the exclusion of evidence in any criminal proceeding except as provided by statute or as required by the United States Constitution; and WHEREAS, the Amendment will prevent California's courts from establishing more strict exclusionary standards than are required by the United States Supreme Court, but will allow California's Legislature to establish more strict standards if they so choose. NOW, THEREFORE. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City of Baldwin Park is in support of Senate Constitutional Amendment 7. SECTION 2. That a certified copy of this Resolution shall be transmitted to Senator Robert Presley. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution.
