A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF BALDWIN PARK
OPPOSING STATE SENATE BILL 999
WHEREAS, the City of Baldwin Park is vitally concerned
about the health and wellbeing of the citizens of the State
of California/ and fireworks can present a danger to the life
and property of those citizens? and
WHEREAS/ the fire hazards of each community are
different and therefore it is appropriate that the local
jurisdictions have the responsibility and authority to protect
the public according to the specific circumstances of the area;
and
WHEREAS, SB 999 would deny local agencies the author-
ity to prohibit the sale of fireworks and the remaining
authority to regulate or prohibit the use of fireworks would
be unenforceable if fireworks were sold in the area where use
was prohibited; and
WHEREAS, there are not statewide compelling reasons
in the public interest to warrant this preemption by the State
of local responsibility.
NOW, THEREFORE, BE IT RESOLVED, that the City Council
of the City of Baldwin Park opposes SB 999 and hereby requests
that the Senate refer the matter to the Senate Committee on
Local Government to provide a public hearing on the bill.
The City Clerk shall certify to the adoption of
this Resolution.
