HomeMy WebLinkAbout1982 006 CC RESO1982 006 CC RESO(Ìììµ peRESOLUTION NO. 82-6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA REQUESTING THE BOARD OF SUPERVISORS OF THE LOS ANGELES COUNTY FLOOD CONTROL DISTRICT OF THE STATE OF CALIFORNIA TO ACCEPT ON BEHALF OF SAID DISTRICT A TRANSFER AND CONVEYANCE OF STORM DRAIN IMPROVEMENTS KNOWN AS MISCELLANEOUS TRANSFER DRAIN NO. S) 802, 796, 603, 597 and 380 IN THE CITY OF BALDWIN PARK FOR FURTHER OPERATION, MAINTENANCE, REPAIR AND IMPROVEMENT, AND AUTHORIZING THE TRANSFER AND CONVEYANCE THEREOF, WHEREAS, there have been dedicated to, or the City has otherwise acquired, the storm drain improvements and drainage system known as Miscellaneous Transfer Drain No s) 802, 796, 603, 597 and 380 described in Exhibit A attached hereto; and WHEREAS, the City is authorized and empowered to transfer and convey to the Los Angeles County Flood Control District any storm drain improvements and drainage system for future operation, maintenance repair, and improvement, and WHEREAS, the City and the Los Angeles County Flood Control District entered into an agreement dated September 18, 1979, and recorded January 23, 1980, as Document Number 80-86-450, of the Official Records in the office of the County Recorder for the County of Los Angeles where- by the City made certain warranties about its future transfers and conveyances of Flood Control facilities to the District; and WHEREAS, the best public interest wi11 be served by transfer and conveyance of the storm drain improvements and drainage system described in Exhibit A attached hereto from the City to the Los Angeles County Flood Control District for future operation, maintenance repair and improvement. NOW, THEREFORE, BE IT RESOLVED, that the City does hereby request the Los Angeles County Flood Control District to accept the transfer and conveyance of the storm drain improvements and drainage system described in said Exhibit A. 1- BIB] 37678-U01 1982-U02 006-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO10313-U03 DO10408-U03 C6-U03 RESO-U03 2/25/2003-U04 ROBIN-U04 1982 006 CC RESO(Ìììµ peResolution No. 82-6 BE IT FURTHER RESOLVED that, subject to the acceptance thereof of the Board of Supervisors of the Los Angeles County Flood Control District, the City Engineer is directed and ordered to prepare all necessary instruments and documents, including deed, to effectuate said transfer and conveyance, and that the Mayor is authorized and instructed to execute said deed and other instruments and documents. District shall have no obligation or responsibility to maintain said storm drain, improvements, and drainage until all rights of way for said drain now vested in the City and all other necessary rights of way therefore have been conveyed to and accepted by District. Reference is hereby made to the plans and profile of said storm drain improvements and drainage systems on file in the office of the City Engineer and on file in the office of the Chief Engineer of said District for futher data as to the exact location, extent, and description of said storm drain improvements and drainage systems. BE IT FUTHER RESOLVED that the transfer and conveyance hereby requested are subject to each of the warranties described in the Agreement between the City and the District dated September 18, 1979, and recorded January 23, 1980, as documented No. No 80-86-450, of the Official Records in the office of the County Recorder for the County of Los Angeles. Such warranties by the City are incorporated herein by this reference. The City Clerk shall certify to the adoption of this Resolution. The Plans consist of three 3) sheets which were approved by the City of Baldwin Park on February 9, 1979, Miscellaneous Transfer Drain No. 796/Ramona Parkway Storm Drain 1600 feet, more or less of reinforced concrete pipe and a11 appurtenances thereto constructed within dedicated public streets and extending along Ramona Parkway from Hart an Avenue to Walnut Street. The plans consist of three 3) sheets which where approved by the City of Baldwin Park on April 5, 1978. Miscellaneous Transfer Drain No. 603/ Athot Street Storm Drain 1620 feet, more or less, of reinforced concrete pipe and a11 appurtenances thereto constructed within dedicated public streets and extending along Athot Avenue from Waco Street to Francisquito Avenue. The plans consists of four 4) sheets which were approved by the City of Baldwin Park on June 11, 1975. Miscellaneous Transfer Drain No. 597/ Datewood Street to Walnut Creek Channel 900 feet, more or less, of reinforced concrete pipe and a11 appurtenances thereto concstructed within a ten 10) feet easement to the City of Baldwin Park and located south of Virginia Avenue between Baldwin Park Boulevard and the Southern Pacific Railroad right-of-way. The plans consist of two 2) sheets which were approved by the City of Baldwin Park on March 10, 1975. Miscellaneous Transfer Drain No. 380/ Ramona Boulevard Storm Drain 1750 feet, more or less, of reinforced concrete pipe and a11 appurtenances thereto constructed within dedicated public streets and extending along Ramona Boulevard from Maine Avenue to Baditto Street. The plans consist of four 4) sheets which were approved by the City of Baldwin Park on March 3, 1971.
