A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BALDWIN PARK DENYING A CHANGE OF ZONE
CLASSIFICATION REQUEST APPLICANT: STERN,
GOLDRICH & KEST: CASE NO. Z-432; LOCATION:
4300 BLOCK OF CENTER STREET).
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE
AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin
Park does hereby find, determine and declare as follows:
a) That owners of certain real property, herein-
after described, filed an application for a change in
zone classification from Zone R-1 to Zone R-1 PD), and
filed an application for approval of a Plan of Development
relating to said property; and
b) That the property to which said matters relate
is as described on the application above referred to
which are on file in the City Planning Division; and
c) That the Planning Commission, by a divided vote,
denied the application for a change in zone classification;
and
d) That the City Council conducted a duly noticed
public hearing on a appeal from the Planning Commission's
decision relating to the matter of a zone change classi-
fication, and upon the application for approval of a Plan
of Development; and
e) That based upon the evidence presented at said
hearing, and each member of the City Council being familiar
with the site, the City Council determined that the public
interest, convenience and necessity did not require the
cange in zone classification as requested.
SECTION 2. That the above described zone change application
be, and the same hereby is, denied.
SECTION 3. That the application for approval of a Plan
Development, relating to the property above described, is inappropriate,
since the change in zone classification was disapproved and, accordingly,
the proceedings relating to such Plan of Development are dismissed.
SECTION 4. That the City Clerk shall certify to the adoption
of this Resolution and shall forward a certified copy hereof to the appli-
cant and to the Secretary of the Planning Commission.
PASSED AND APPROVED this 3rd day of February, 1982.
