A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BALDWIN PARK DENYING AN AMENDMENT TO THE
LAND USE ELEMENT OF THE GENERAL PLAN AGP-55).
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin Park does
resolve as follows:
a. That pursuant to the applicable provisions of the Planning and
Zoning Law Section 65300 et seq. of the Government Code of the
State of California), studies were commenced for the purpose of
amending the Land Use Element of the City's General Plan; and
b. That the Planning Commission has conducted a noticed public
hearing on the proposed amendment to the said Land Use Element,
as hereinafter described; and
c. That the Planning Commission has recommended denial of the
said proposed amendment; and
d. That the City Council has conducted a noticed public hearing on
said recommendations, and has determined that the public interest
does not require the approval of AGP-55; and
e. That the changes as outlined are contrary to the spirit and
intent of the General Plan; and
f. That the amendment proposed for approval, as above described, is
not in the public interest and the general welfare; and
g. That the granting of the amendment as above described, will
be materially detrimental to the public welfare or injurious to
the property or improvements in the immediate vicinity, and will
not promote the public welfare in the immediate vicinity and in
the City at large.
SECTION 2. That the Land Use Element of the City's General Plan, as
set forth on Exhibit B", attached hereto, and incorporated herein by this
reference be, and the same hereby is denied.
SECTION 3. That the City Clerk shall certify to the adoption of this
Resolution and shall cause the same to be processed^ the manner required by law.
