HomeMy WebLinkAbout1982 079 CC RESO1982 079 CC RESO(ÌììpeRESOLUTION NO. 82-79 A,RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING AN APPLICATION BY WOODLAND PACIFIC DEVELOPMENT, INC TO DEVELOP A 129 UNIT RESIDENTIAL CONDOMINIUM PROJECT. THE CITY COUNCIL OF THE CITY OF BALWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park hereby finds, determines, and declares as follows: a) That on the 15th day of September, 1982, the City Council held a duly noticed public hearing on an application to develop a 129 unit residential condominium project located on 6.5 +/- acres at the southeasterly corner of Barnes Avenue and Ramona Boulevard, more particularly described as property located at 12808 through 12834 Ramona Boulevard and 3624 through 3654 Barnes Avenue book 8551, page 9, parcels 19, 20, 21 and book 8551, page 10, parcels 21, 22, 23, 24, 25, 26 and 27 of the County Assessor's Records). b) That the proposed project, attached hereto as Exhibit A" and incorporated herein by this reference, has been designed and reviewed in accordance with the provisions of Section 9800 et. seq. of the Baldwin Park Zoning Code. SECTION 2. That the City Council at the time of the public hearing determined that pursuant to Section 15067 of CEQA, no further environmental analysis is necessary relating to the proposed development. SECTION 3. That the City Council does hereby make the following findings of fact: 1. The proposed development is consistent with the spirit and intent of the General Plan and its elements; 2. The proposed development is not detrimental to surrounding properties; 3. The proposed project is a logical and rational development of the land; 4. That the proposed development is consistent with the spirit and intent of the Planned Development Overlay Ordinance. SECTION 4. That the City Council does hereby approve the project and adopt the following conditions: 1. That the property be developed as shown on Exhibit E", dated August 25, 1982; 2. That should the applicant secure a Density Bonus agreement pursuant to State Law, the property shall be developed as shown on Exhibit A", dated August 25, 1982; 3. That the applicant shall provide to the Planning Division, within thirty days of the effective date of City Council adoption, revised plans to include the type, size and location of a11 on site exterior lighting, revised landscape plans noting those existing trees to be saved, colored and textured paving at a11 entrances and intermittently throughout the development, floor plans, proposed elevations and landscape plans of the four 4) existing dwellings along Barnes Avenue which wi11 remain. That construction shall commence within one 1) year of the effective date of City Council adoption; 5. That a subdivision map and necessary public improvement plans be submitted as required by the City with the proposed Covenant, Conditions and Restrictions for review and approval; 6. That the following public improvements be constructed: A. Furnish and install traffic signal with left turn phase at Barnes and Ramona intersections with appropriate signing and pavement markings to the satisfaction of the City Engineer. B. Construct median island modifications and appropriate signing and pavement markings along Ramona Boulevard to facilitate left turning movement at Barnes to the satisfaction of the City Engineer. C. Remove existing curb depression-and drive approaches along Ramona and Barnes that wi11 not be utilized by this project and replace with full curb per city standards. D. Furnish and install eight 8) street trees per city standards along Ramona Boulevard. E. Construct five foot wide sidewalk along Ramona Boulevard and Barnes Avenue per city standards. F. Construct drive approaches along Ramona Boulevard and Barnes Avenue per city standards. G. Furnish and install six 6) street trees per city standards along Barnes Avenue. 7. That the applicant sign a notarized affidavit within fifteen 15) days after the adoption of the resolution that the applicant has read a11 the conditions of approval. SECTION 5. That an agreement be executed as provided by Section 65915 of the Government Code containing the following provisions: 1. That a total of six 6) additional dwelling units be permitted above and beyond the zoning code maximum as a density bonus within the R-G zoned portion of the development. 2. That not less than twenty five 25) percent of the total proposed project dwelling units be set aside by appropriate covenants, conditions and restrictions for sate to persons of low or moderate income. 3. That the plan, as approved by the City Council, be constructed and maintained subject to modifications as permitted by the Zoning Code. SECTION 6. That the City Clerk shall certify the adoption of this Resolution, and cause the same to be published in the manner prescribed by law.
