A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BALDWIN PARK AMENDING THE BALDWIN PARK
ENVIRONMENTAL GUIDELINES.
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS
FOLLOWS:
SECTION 1. That subsection 6.2.A.3 be amended to read as follows:
3- PUBLIC REVIEW
Notice that the City proposes to adopt a Negative
Declaration shall be provided to the public at
least ten 10) days prior to the adoption of the
Negative Declaration. Such notice shall be
accomplished by publication in a newspaper of
general circulation within the City and by
conspicuous posting of properties within 300 feet
from the external boundary of the proposed project.
At the time of notification all information relative
to the Negative Declaration shall be available for
review at the public counter. If the project for
which the Negative Declaration has been prepared
requires legislative approval, the Negative Declaration
reviewed concurrently with the project
at a public hearing. If no legislative
is necessary, no public hearing is required;

the Director may call a public hearing if,
it is necessary to ensure adequate
review of the project's impacts. At the conclusion
of the public review process, the appropriate
reviewing body, as defined herein Chapter Four) shall
find either a) that the project will not have
a significant adverse impact on the environment and
that an E.I.R. is not required, or b) that the project
will have a significant adverse impact on the environ-
ment and a draft E.I.R. is required."
Section 2. That subsection 6.2.A.5 be amended to read as follows:
5. CIRCULATION AND PUBLIC REVIEW OF DRAFT E.I.R.
Upon completion of the draft E.I.R., the City shall place
copies at City Hall and the public library and shall
distribute other copies as required by law. The City
shall give notice, by publication in a newspaper of
general circulation within the City and by conspicuous
posting of properties within 300 feet from the external
boundary of the proposed project, at least thirty 30)
days prior to action on the draft E.I.R. in order to
allow for adequate public review. If the project for
which the draft E.I.R. has been prepared requires
legislative approval, the draft E.I.R. shall be reviewed
concurrently with the proposed project at a public
hearing. If no legislative approval is necessary, no
public hearing is required; however, the Director may
call for a public hearing if, in his opinion, it is
necessary to ensure adequate review of the draft E.I.R.
Upon completion of the public review process, a final
E.I.R. shall be prepared in accordance with CEQA Sections
15085 and 15146)."

Section 3. That Resolution No. 82-85 which established regulations
for processing environmental impact reports is hereby
amended.
Section 4. That the City Clerk is hereby directed to certify
to the passage of this Resolution and shall cause a
certified copy thereof, to be recorded in the Office
of the County Recorder, Los Angeles County, California.
