HomeMy WebLinkAbout1983 061 CC RESO1983 061 CC RESO(ÌìëFRESOLUTION NO. 83- 61 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A DEVELOP- MENT REVIEW APPLICATION BY PACIFIC WESTERN COMMUNITIES TO DEVELOP A 20 UNIT RESIDENTIAL CONDOMINIUM PROJECT AT 3612 & 3618 BARNES AVENUE CASE NO. DR-2). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park hereby finds, determines, and declares as follows: a) That on the 15th day of June, 1983 the City Council held a duly noticed public hearing on an application to develop a 20 unit residential condominium project located at 3612 and 3616 Barnes Avenue Map Book 8551, Page 10, Parcels 28 and 29, of the Los Angeles County Assessor). b) That the proposed project, attached hereto as Exhibit A" and incorporated herein by this reference, has been designed and reviewed 1n accordance with the provisions of Section 9800 et. seq. of the Baldwin Park Zoning Code. SECTION 2. That the City Council at the time of the public hearing determined that pursuant to Section 15067 of CEQA, no further environmental analysis is necessary relating to the proposed development. SECTION 3. That the City Council does hereby approve the project and adopt the following conditions: 1. That the subject property be developed as shown on Exhibit A," dated June 15, 1983; and 2. That the applicant shall provide to the Planning Division for review and approval, within thirty 30) days of the effective date of the City Council adoption, revised plans to include the location of alt exterior site lighting, mail boxes, and the location of trash enclosures or an agreement with the local refuse company for pick up on-site; and 3. That the applicant shall enter into a Density Bonus Agreement pursuant to Section 65915 of the Government Code, or construct only 19 dwelling units on the subject property; and 4. That construction shall commence within one 1) year of the effective date of City Council adoption, or the approval shall be null and void; and 5. That a subdivision map, necessary public improvement plans, and Covenant, Conditions, and Restrictions shall be submitted for review and approval; and 6. That the applicant sign a notarized affidavit within fifteen 15) days after the adoption of the resolution that the applicant has read all the conditions of approval. SECTION 4. That an agreement be executed as provided by Section 65915 of the Government Code containing the following provisions: 1. That a total of one 1) additional dwelling unit be permitted above and beyond the zoning code maximum as a density bonus. 2. That not less than twenty-five 25) percent of the total proposed project dwelling units be set aside by appropriate covenants, conditions and restrictions for sale to persons of low or moderate income. That the plan, as approved by the City Council, be constructed and maintained subject to modifications as permitted by the Zoning Code. SECTION 5. That the City Clerk shall certify the adoption of this Resolution, and cause the same to be published in the manner prescribed by law.
